HOUSE BILL 2724

 

 

 

AN ACT

 

amending Title 15, chapter 12, article 2, Arizona Revised Statutes, by adding sections 15-1421, 15-1422, 15-1423 and 15-1424; AMENDING Title 41, chapter 27, article 2, Arizona Revised Statutes, by adding section 41-3020.01; making an appropriation; relating to community colleges.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 12, article 2, Arizona Revised Statutes, is amended by adding sections 15-1421, 15-1422, 15-1423 and 15‑1424, to read:

START_STATUTE15-1421.  Members; appointment; terms; vacancy; oath

A.  The state board of directors for community colleges is established consisting of the following members:

1.  Two members from a county with a population of at least three million persons, who are appointed by the governor pursuant to section 38‑211.

2.  One member from a county with a population of at least eight hundred thousand persons but less than three million persons, who is appointed by the governor pursuant to section 38‑211.

3.  Three members, each from a different county with a population of less than eight hundred thousand persons, who are appointed by the governor pursuant to section 38‑211.

4.  One member from any county in this state, who is appointed by the governor pursuant to section 38‑211.

5.  The president of the Arizona board of regents, who shall be a nonvoting ex officio member.

6.  The presiding officer of the state board of education, who shall be a nonvoting ex officio member.

7.  The superintendent of public instruction, who shall be a nonvoting ex officio member.

B.  The term of each member appointed by the governor shall be four years, to begin and end on the third Monday in January.

C.  Notwithstanding section 38‑291, the office of a member of the state board of directors for community colleges is deemed vacant if the person holding the office ceases to be a resident of the county for which the person was appointed.

D.  Each appointive member of the state board of directors for community colleges, before entering on the duties of office, shall take the oath of office. END_STATUTE

START_STATUTE15-1422.  Officers; organization; meetings; immunity

A.  The state board of directors for community colleges shall select from its membership a chairperson, a treasurer and any other officers it deems necessary.  The state board shall hold at least quarterly meetings each year and may hold such special meetings, at the call of the chairperson, as may be deemed necessary or advisable.

B.  A majority of the membership of the state board constitutes a quorum for the transaction of business at any meeting regularly called, but a number less than a quorum may adjourn from time to time.

C.  Members of the state board are immune from personal liability with respect to all acts done and actions taken in good faith within the scope of their authority during duly constituted regular and special meetings. END_STATUTE

START_STATUTE15-1423.  Compensation of board members

All members of the state board of directors for community colleges who are appointed by the Governor shall receive compensation as determined pursuant to section 38-611 for each day of attendance at board meetings. END_STATUTE 

START_STATUTE15-1424.  Powers and duties

A.  With consensus from the community college districts in this state, The state board of directors for community colleges may receive monies from community college districts in this state for the purpose of conducting work on issues pertaining to the statewide community college system.

B.  The state board shall:

1.  Provide statewide planning and coordination of the statewide community college system in a manner that preserves the authority of locally elected community college district governing boards.

2.  Provide a statewide focus on the need for affordable and accessible delivery of educational services to community college students.

3.  Review existing funding amounts, funding sources and funding mechanisms for community college districts and provide recommended funding changes, as necessary, to the community college districts, the governor and the legislature.

4.  In collaboration with the Arizona board of regents, establish a centralized location for the development of a seamless articulation system that maximizes the transfer of credits toward degrees between community colleges and postsecondary institutions that award four-year degrees.

5.  Establish statewide goals and performance measures for the statewide community college system.

6.  In collaboration with community college districts and the Arizona board of regents, develop plans for an online state college system that includes both community colleges and universities.

7.  coordinate capital projects that may be funded by this state on behalf of the statewide community college system, including, if authorized by the legislature, the issuance of bonds for systemwide capital projects.

8.  Provide a centralized location for the tracking of community college data and develop longitudinal data systems to assist the community college districts in this state. END_STATUTE

Sec. 2.  Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 41-3020.01, to read:

START_STATUTE41-3020.01.  State board of directors for community colleges; termination July 1, 2020

A.  The state board of directors for community colleges terminates on July 1, 2020.

B.  Title 15, chapter 12, article 2 is repealed on January 1, 2021.END_STATUTE

Sec. 3.  Initial terms of members of the state board of directors for community colleges

A.  Notwithstanding section 15-1421, Arizona Revised Statutes, as added by this act, the initial terms of the appointed members of the state board of directors for community colleges are:

1.  One term ending on the third Monday in January, 2012.

2.  Two terms ending on the third Monday in January, 2013.

3.  Two terms ending on the third Monday in January, 2014.

4.  Two terms ending on the third Monday in January, 2015.

B.  The governor shall make all subsequent appointments as prescribed by statute.

Sec. 4.  Purpose

Pursuant to section 41-2955, subsection E, Arizona Revised Statutes, the legislature establishes the state board of directors for community colleges to provide for the government, oversight, planning and coordination of the community college system in areas of statewide concern.

Sec. 5.  Appropriation; state board of directors for community colleges; start‑up costs

The sum of $150,000 is appropriated from the state general fund in fiscal year 2010-2011 to the state board of directors for community colleges for initial start‑up costs.
