AN ACT

 

amending title 13, chapter 12, Arizona Revised Statutes, by adding section 13‑1215; relating to assault.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 12, Arizona Revised Statutes, is amended by adding section 13-1215, to read:

START_STATUTE13-1215.  Bias motivated intimidation of first responders; classification; definition

A.  A person commits bias motivated intimidation if the person maliciously and intentionally intimidates, harasses or terrorizes another person because of that person's actual or perceived employment as a first responder and the intimidation, harassment or terror causes either of the following:

1.  The death of or serious physical injury to another person.

2.  Damage to or the destruction of any real or personal property of another person because of the person's actual or perceived employment as a first responder, without permission, and the amount of the damage exceeds $500 or the value of the destroyed property exceeds $500.

B.  A violation of this section is a class 4 felony.  The sentence shall run consecutively to any other sentence imposed on the defendant and to any undischarged term of imprisonment of the defendant.

C.  For the purposes of this section, "first responder" means a peace officer, a firefighter of a city, town, county, fire district or volunteer fire department and an emergency medical technician or paramedic. END_STATUTE
