SENATE BILL 1407

 

 

 

AN ACT

 

amending title 38, chapter 3, Arizona Revised Statutes, by adding article 11; relating to registration and reporting for public bodies.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 38, chapter 3, Arizona Revised Statutes, is amended by adding article 11, to read:

ARTICLE 11.  REGISTRATION AND REPORTING FOR PUBLIC BODIES

START_STATUTE38-539.  City, town, county and school district construction contracts; registration and reporting

A.  Notwithstanding any other law, any person with a financial interest in a procurement or potential award of a contract by a city, town, county or school district for construction materials or construction services, or both, shall register and report as prescribed in subsection B of this section if all of the following apply:

1.  The procurement, contract or award is for a project that costs five hundred thousand dollars or more.

2.  The person provides a gift or anything of value, including food or beverage, to the person holding elected office in the city, town, county or school district that is procuring or awarding the contract.

B.  A person who is required to register and report pursuant to subsection A of this section shall:

1.  File a registration form with the clerk of the elective body of the applicable jurisdiction that does the following:

(a)  States the person's name, address, contact information and name and address of that person's employer and the nature of that business.

(b)  Includes the name of the project, the project number, if any, and a description of the project.

2.  Report any gift or anything of value that is provided to the person who holds elective office in that jurisdiction by stating the fair market value of the gift or stating the amount of any expenditure made and identifying the person holding elective office who received the gift or other benefit.

C.  A person who is required to register pursuant to this section shall register within five days after making the expenditure or providing the benefit and shall file the report prescribed by subsection B, paragraph 2 of this section by the fifth day of each month following any month in which an expenditure was made or the benefit was provided.
