AN ACT

 

amending Title 41, chapter 7, article 8.1, Arizona Revised Statutes, by adding section 41-1240; relating to registration and regulation of lobbyists.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 8.1, Arizona Revised Statutes, is amended by adding section 41-1240, to read:

START_STATUTE41-1240.  Application to counties, cities, towns, school districts; filing officer

A.  Notwithstanding any other law, this article applies to all of the following:

1.  Persons who hold elective office in counties, cities, towns and school districts, and these persons are deemed to be the elected officials who are being lobbied for purposes of regulating the lobbying of county boards of supervisors, city and town councils and school district governing boards pursuant to this article.

2.  Persons who attempt to influence any official action, including the passage or defeat of any matter in that county, city, town or school district by directly communicating with county boards of supervisors, city and town councils and school district governing boards, and these persons are deemed to be lobbyists for purposes of regulating lobbyists pursuant to this article.

3.  Persons that employ, retain, engage or use, with or without compensation a lobbyist to lobby a county board of supervisors, a city or town council or a school district governing board, and these persons are deemed to be principals for purposes of regulating principals pursuant to this article.

B.  For the purposes of filing and enforcement of this article in counties, cities, towns and school districts pursuant to this section, the clerk of the county board of supervisors, the clerk of the city or town or the clerk of the school district governing board, as appropriate, shall perform the duties of the secretary of state.
