An act to amend Section 1729 of the Labor Code, relating to employment.

AB 1768, as introduced, Carrillo.
Contractors: subcontractor withholding.
Existing law regulates public works contracts and imposes certain duties on contractors and subcontractors, as specified. Existing law authorizes a contractor to withhold from a subcontractor sufficient sums to cover any penalties withheld from the contractor by the awarding body on account of the subcontractor’s failure to comply with the provisions described above. Existing law also authorizes a contractor to recover the amount of the penalty or forfeiture in a suit at law if payment has already been made to the subcontractor.
This bill would make technical, nonsubstantive changes to this provision.
