An act to add Chapter 2.3 (commencing with Section 5390) to Division 5 of the Public Resources Code, relating to public lands.

AB 2076, as introduced, Bigelow. Public lands: Department of Parks and Recreation: wildfire management plan: fire hazard severity zones.

Under existing law, the Department of Parks and Recreation controls the state park system, which is made up of units. Existing law also gives the department authority over, among other areas, state vehicular recreation areas, as provided, and makes the Director of Parks and Recreation responsible for planning and for the orderly development and operation of the California Recreational Trails System. Existing law requires the department to administer, protect, develop, and interpret the property under its jurisdiction for the use and enjoyment of the public.

Existing law requires the Director of Forestry and Fire Protection to identify areas in the state as very high fire hazard severity zones, as provided. Existing law also requires the director to classify lands within state responsibility areas into fire hazard severity zones, as provided.

This bill would require the Director of Parks and Recreation to develop, in specified phases, and implement a wildfire management plan for all property under the jurisdiction of the Department of Parks and Recreation that is located within a high or a very high fire hazard severity zone, as provided. The bill would require the wildfire management plan to outline the department’s fire prevention goals and future projects for prescribed fire, defensible space, fire resilient restoration projects, and the fire hardening of the department’s structures, among other things. The bill would require the department to post the complete wildfire management plan on its internet website, as provided.

The people of the State of California do enact as follows:

SECTION 1.

 Chapter 2.3 (commencing with Section 5390) is added to Division 5 of the Public Resources Code, to read:

CHAPTER  2.3. Wildfire Management Plan for Property in Fire Hazard Severity Zones

5390.

 (a) The director shall develop, pursuant to subdivision (d), and implement a wildfire management plan for all property under the jurisdiction of the department that is located within a very high fire hazard severity zone, as identified by the Director of Forestry and Fire Protection pursuant to Section 51178 of the Government Code, or a high or a very high fire hazard severity zone, as identified by the Director of Forestry and Fire Protection pursuant to Article 9 (commencing with Section 4201) of Chapter 1 of Part 2 of Division 4.

(b) The wildfire management plan shall outline the department’s fire prevention goals and future projects for prescribed fire, defensible space, fire resilient restoration projects, and the fire hardening of the department’s structures.

(c) The wildfire management plan shall also include recommendations for policy changes and resources needed for the department to adapt to the increasing high severity wildfire threat.

(d) On or before January 1, 2024, the department shall have completed the development of the first one-half of the wildfire management plan described in subdivision (a). On or before January 1, 2026, the department shall have completed the second one-half of the wildfire management plan described in subdivision (a).

(e) On or before January 1, 2026, the department shall post the complete wildfire management plan on its internet website.
