An act to add Section 1685.2 to the Vehicle Code, relating to vehicles.

AB 2423, as introduced, Low. Department of Motor Vehicles: private partnerships: specialized and personalized license plates.
Existing law requires a motor vehicle that is operated upon a highway to be registered, and requires the Department of Motor Vehicles to issue license plates, as described, to a vehicle that has been registered. Existing law requires a motor vehicle to display license plates. Existing law requires the department to issue certain specialized license plate designs and to issue a license plate with a combination of numbers and letters assigned by the department or, upon request and subject to approval, with a personalized combination of numbers or letters.
Existing law authorizes the department to enter into contractual agreements with qualified private industry partners for the purpose of providing specified services related to the titling and registration of vehicles.
This bill would express the intent of the Legislature to enact legislation that would establish a new pathway for license plate design with a private industry partner.
The bill would require the department to enter into a contractual agreement with a private industry partner to provide services related to the marketing, order processing, manufacturing, and delivery of specialized and personalized license plates, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 It is the intent of the Legislature to enact legislation that would establish a new pathway for license plate design with a private industry partner.

SEC. 2.

 Section 1685.2 is added to the Vehicle Code, to read:

1685.2.
 (a) The department shall, in conformance with Article 4 (commencing with Section 19130) of Chapter 5 of Part 2 of Division 5 of Title 2 of the Government Code, enter into a contractual agreement for not less than 60 months with a qualified private industry partner to provide services related to the marketing, design, order processing, manufacturing, and delivery of specialized license plates and environmental license plates, as defined in Section 5103. The contract may authorize the private industry partner to provide similar services for existing specialized and environmental license plates. A contract may be renewed for up to two additional terms of not less than 60 months each with the initial term commencing upon public launch of the private industry partner program.
(b) The purpose of a partnership created pursuant to this section is to provide new revenue to the state by increasing public interest in and access to specialized and environmental license plates.
(c) A license plate designed, manufactured, ordered, or delivered pursuant to a contract authorized by this section shall comply with all applicable provisions of this code regarding specialized and environmental license plates, except that there shall be no required minimum number of applications per particular special interest plate as set forth in Section 5060. The department shall retain the authority to reject any registration number or design pursuant to neutral criteria developed by the department to ensure that the approval or rejection of a registration number or design is not based on the content or viewpoint of the speech being considered. The department shall have the authority to offer private industry partner license plates to the public for annual and multiyear term lengths.
(d) A contract entered into pursuant to this section shall provide sufficient revenue to the department to offset any cost incurred by the department for the setup and ongoing maintenance of the program. Accordingly, the department may authorize a private industry partner to assess a convenience or processing fee for license plate transactions conducted through the private industry partner, in an amount determined by the department, or may enter a fee sharing agreement with the private industry partner from revenues generated by services rendered by the private industry partner, as determined by the department.
(e) Notwithstanding Section 5060.1, any fees for a new specialized license plate designed pursuant to this section in excess of the amounts described in subdivision (d) may be collected as donations to either of the following:
(1) To an entity specified by the license plate sponsor and related to the design of the license plate that qualifies for tax-exempt status under Section 501(c)(3) of the Internal Revenue Code and Section 23701d of the Revenue and Taxation Code.
(2) To the department for deposit into the California Environmental License Plate Fund.
(f) The department may adopt rules and regulations necessary to implement this section.
