An act to amend Section 19090 of the Streets and Highways Code, relating to street lighting.

AB 3114, as introduced, Calderon. The Highway Lighting District Act: elections.
The Highway Lighting District Act authorizes any unincorporated area in the state to be established as a highway lighting district for purposes of installing and maintaining a street lighting system on public highways. The act authorizes proceedings to form a highway lighting district to be instituted by filing a petition meeting certain requirements with the county board of supervisors. After completion of a specified protest proceeding, and in certain instances, the act requires the county board of supervisors to order an election to be held in the proposed district to determine if the district shall be formed.
This bill would make a nonsubstantive change to the latter provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 19090 of the Streets and Highways Code is amended to read:

19090.
 Within 30 days after acquiring jurisdiction to proceed, the board of supervisors shall by resolution shall, by resolution, order that an election be held in the proposed district to determine whether or not the district shall be formed. The board may establish one or more voting precincts within the district and appoint one inspector, one judge, and two clerks residing in the district for each voting precinct to conduct the election, which shall be held on the next established election date not less than 130 days after the date of the resolution ordering it to be held.
