LEGISLATIVE COUNSEL'S DIGEST
Existing law establishes in the Natural Resources Agency the Department of Forestry and Fire Protection. Existing law requires the department to be responsible for the fire protection, fire prevention, maintenance, and enhancement of the state’s forest, range, and brushland resources, contract fire protection, associated emergency services, and assistance in civil disasters and other nonfire emergencies. Existing law requires any person that owns, controls, operates, or maintains any electrical transmission or distribution line upon any mountainous land, or in forest-covered land, brush-covered land, or grass-covered land, to, during those times and in those areas that are determined to be necessary by the director of the department or the agency that has primary responsibility for the fire protection of
those areas, maintain a clearance of specified distances in all directions between all vegetation and all conductors that are carrying electric current.
This bill would require the department to act as the lead agency for purposes of investigating any wildfire, including any wildfire that may have been caused by an electrical transmission.

The people of the State of California do enact as follows:
SECTION 1.
Section 3203.5 is added to the Public Resources Code, to read:3203.5.
(a) The Legislature finds and declares both of the following:SEC. 2.
No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.The department shall act as the lead agency for purposes of investigating any wildfire, including any wildfire that may have been caused by an electrical transmission.
