BILL NUMBER: SB 1385 AMENDED BILL TEXT AMENDED IN SENATE MARCH 29, 2016 INTRODUCED BY Senator Leyva FEBRUARY 19, 2016 An act toamend Section 85304 of the Education Code, relating to community colleges.add Section 8686.5 to the Government Code, relating to emergency assistance. LEGISLATIVE COUNSEL'S DIGEST SB 1385, as amended, Leyva.Community colleges: optional method for registering warrants.California Disaster Assistance Act: Inland Regional Center. The California Disaster Assistance Act generally provides that the state share for disaster project allocations to local agencies is no more than 75% of total state eligible costs, except for specified events for which the state share is up to 100% of state eligible costs. This bill would add the December 2, 2015, shooting that occurred at the Inland Regional Center to the list of events for which the state share of state eligible cost is up to 100%, and would make findings and declarations as to the necessity of a special law.When an order on community college district funds is received by the county superintendent of schools, and there is insufficient money in the fund or funds against which the order is drawn to pay the orders in full, existing law requires the order to be registered as a warrant on the county treasurer and transmitted to the governing board of the community college district, as specified. Existing law requires county auditors, within 10 days after the end of each month, to report to the superintendent of schools the amount of interest added to registered warrants and paid during the preceding month.This bill would make a nonsubstantive change to that provision relating to reports by county auditors.Vote: majority. Appropriation: no. Fiscal committee:noyes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 8686.5 is added to the Government Code , to read: 8686.5. Notwithstanding subdivision (a) of Section 8686, the state share shall be 100 percent of total state eligible costs connected with the shooting that occurred at the Inland Regional Center on December 2, 2015. SEC. 2. The Legislature finds and declares that a special law is necessary and that a general law cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique costs incurred by local agencies in responding to the December 2, 2015, shooting that occurred at the Inland Regional Center.SECTION 1.Section 85304 of the Education Code is amended to read: 85304. Within 10 days after the end of each month, the county auditor shall report to the superintendent of schools the amount of interest added to registered warrants and paid during the preceding month. The report shall show each district to whose registered warrants, paid during the month covered by the report, interest was added and the amount of that interest for the district. The superintendent of schools shall immediately report, in writing, to the clerk or secretary of each district for which interest was paid, the amount of the interest paid for the district.
