AN ACT CONCERNING CHEMICALS OF CONCERN TO CHILDREN.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) Not later than January 15, 2013, the Commissioner of Public Health shall, within available appropriations and in consultation with the Commissioner of Energy and Environmental Protection, the Commissioner of Consumer Protection and the Chemical Innovations Institute within The University of Connecticut Health Center, established pursuant to section 22a-903 of the general statutes, submit a report concerning the regulation of chemicals of concern to children. Such report shall include, but shall not be limited to: (1) A list of chemicals identified by other states to be of concern to children and a description of any action taken by a state to regulate such chemicals; (2) a description of programs administered by other states and governmental entities that evaluate and regulate such chemicals; (3) a description of regulations in the state relating to the use of such chemicals in manufacturing and the disposal of such chemicals; (4) a description of programs administered by the Department of Energy and Environmental Protection that regulate the use of such chemicals; (5) an evaluation of the feasibility of the Department of Consumer Protection to monitor and enforce the regulation of such chemicals, including bans or limits on the use of such chemicals, labeling and reporting on the use of such chemicals; (6) an opinion as to whether the state should regulate any such chemical; (7) recommendations for ways to improve the state's regulation of such chemicals, including (A) the feasibility of identifying priority chemicals from the list of chemicals identified pursuant to subdivision (1) of this section, (B) the use of safer alternatives to such chemicals, and (C) the implementation of labeling, consumer warnings, reporting, content limits and the ban or phase-out of the use of one or more of such chemicals; and (8) an evaluation of the potential use of green chemistry to remediate the effects of such chemicals. The Commissioner of Public Health shall submit such report, in accordance with the provisions of section 11-4a of the general statutes, to the joint standing committees of the General Assembly having cognizance of matters relating to public health, the environment and consumer protection.
