AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO REGISTRATION OF VEHICLES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §2131, Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 2131. Effect and duration of temporary registration plates; destruction upon expiration. expiration; use of temporary tag system.

(a) (1) A temporary registration plate properly issued to an owner or purchaser of a vehicle in accordance with § 2129 or § 2130 of this title shall be valid and shall entitle said owner or purchaser to operate the vehicle for which issued upon the public highways for a period of 60 90 days from the date of issuance or until the issuance of a permanent registration plate or until the cancellation or rescission of the contract of purchase, whichever occurs first.

(2) A temporary registration plate properly issued by a certified repair technician to a customer’s expired vehicle for the purpose of verifying repairs in accordance with § 2129 or § 2130 of this title shall be valid and shall entitle said certified repair technician to operate the vehicle for which issued upon the public highways for a period of not more than 60 days from the date of issuance.

(b) Upon the expiration of a temporary registration plate the holder thereof shall immediately destroy the same.

(c) A temporary registration plate properly issued to an owner or purchaser of a vehicle under §2129 or §2130 of this title must use a temporary tag system, approved by the Department of Motor Vehicles, unless the Division of Motor Vehicles has determined that a motor vehicle dealer or other authorized temporary tag issuer is not permitted to use the temporary tag system, and must purchase plates from the Division of Motor Vehicles pursuant to §2129(b) of this title.

Section 2. The Division of Motor Vehicles may promulgate rules and regulations to implement and administer this Act.

Section 3. Section 1 of this Act takes effect 60 days following its enactment into law.
