HOUSE BILL NO. 24

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO LOBBYISTS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend §5837, Title 29 of the Delaware Code by renumbering it as §5838 and by substituting in lieu thereof a new §5837 as follows:

"§ 5837.Lobbying restrictions for members of the General Assembly, heads of state agencies, Cabinet officials, and the executive staff of the Governor.

A person who has served as a member of the General Assembly, as the head of a State agency (as defined by§5903(4) of this title), as a State Cabinet official (as defined by §5812(n)(13)-(14) of this title), or who has served on the executive staff of the Governor (as exempted from the Merit System of Personnel Administration as defined by §5903 of this title), may not act as a lobbyist for a period of one (1) year after the person's term of office or State employment ends.A person who violates this section is guilty of an unclassified misdemeanor.".

Section 2.This Bill becomes effective on January 10, 2012.



SYNOPSIS

This Bill restricts members of the General Assembly, heads of State agencies, Cabinet Officials and the Executive Staff of the Governor from lobbying for a period of one (1) year after their term of office ends or State employment ends.The Bill makes the penalty an unclassified misdemeanor.
