DELAWARE STATE SENATE

146th GENERAL ASSEMBLY

SENATE BILL NO. 4

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO MEMBERS OF THE GENERAL ASSEMBLY AND STATEWIDE ELECTED OFFICIALS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Title 29 of the Delaware Code, by adding a new §5817, to read as follows:

"§5817. Disclosure of Certain Financial Information.

(a) In addition to any other reporting requirements, each member of the General Assembly shall disclose monthly, on a report to be provided by the Public Integrity Commission, the following:

(1) All income from any source other than his or her General Assembly position.

(2) Documentedtime records evidencing the amount of time worked, on session days, at all places of employment other than his or her General Assembly position.

(3) Disclosure of the amount the General Assembly member's compensation from separate places of employment has been reduced on session days for time he or she spent performing the duties of the General Assembly, or a declaration that his or her employment compensation has not been reduced on such days.

(b) In addition to any other reporting requirements, each statewide elected official shall disclose monthly on a report to be provided by the Public Integrity Commission, the following:

(1) All income from any source other than his or her statewide elected position.

(2) Documented time records evidencing the amount of time worked at all places of employment other than his or her statewide elected position for any day he or she performed official duties of the statewide elected position.

(3) Disclosure of the amount his or her compensation from his or her separate places of employment has been reduced on days he or she performed official duties of the statewide elected position, or a declaration that his or her employment compensation has not been reduced on such days.

(c) The monthly reports required by this section shall be submitted to the Public Integrity Commission not later than the 15th of the month following eachreporting period."

Section 2. Amend §5815, Title 29, Delaware Code, by adding in subsections (a) and (b), after the phrase "5813A", the phrase "or §5817" at each location.

Section 3. Notwithstanding any other law to the contrary, the Public Integrity Commission shall develop forms and procedures for the filings required by this Act. All filings shall be posted by the Public Integrity Commission on its website.

Section 4. Sections 1 and 2 shall be effective January 1, 2012. Section 3 shall be effective immediately upon enactment.


SYNOPSIS

This Act requires members of the General Assembly and statewide elected officials to disclose all separate income and the hours worked in separate employment during days when they perform official duties. It also requires documentation of any reduction in compensation for the official's separate employment, or a declaration that their compensation has not been reduced.
