A bill to be entitled
2An act relating to instructional materials for K-12 public
3education; amending s. 1006.28, F.S.; including electronic
4textbooks in the definition of the term "adequate
5instructional materials"; requiring each district school
6board to provide technology as needed for its educational
7program; amending s. 1006.40, F.S.; authorizing the use of
8certain funds for the purchase of electronic textbooks by
9district school boards; providing for the purchase of
10electronic or computer hardware under certain conditions;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (1) of section 1006.28, Florida
16Statutes, is amended to read:
17 1006.28 Duties of district school board, district school
18superintendent; and school principal regarding K-12
19instructional materials.-
20 (1) DISTRICT SCHOOL BOARD.-The district school board has
21the duty to provide adequate instructional materials for all
22students in accordance with the requirements of this part. The
23term "adequate instructional materials" means a sufficient
24number of textbooks or sets of materials that are available in
25bound, unbound, kit, or package form and may consist of hard-
26backed, or soft-backed, or electronic textbooks, consumables,
27learning laboratories, manipulatives, electronic media, and
28computer courseware or software that serve as the basis for
29instruction for each student in the core courses of mathematics,
30language arts, social studies, science, reading, and literature,
31except for instruction for which the school advisory council
32approves the use of a program that does not include a textbook
33as a major tool of instruction. The district school board has
34the following specific duties:
35 (a) Courses of study; adoption.-Adopt courses of study for
36use in the schools of the district.
37 (b) Textbooks.-Provide for proper requisitioning,
38distribution, accounting, storage, care, and use of all
39instructional materials furnished by the state and furnish such
40other instructional materials as may be needed. The district
41school board shall assure that instructional materials used in
42the district are consistent with the district goals and
43objectives and the curriculum frameworks adopted by rule of the
44State Board of Education, as well as with the state and district
45performance standards provided for in s. 1001.03(1).
46 (c) Other instructional materials.-Provide such other
47technology and teaching accessories and aids as are needed for
48the school district's educational program.
49 (d) School library media services; establishment and
50maintenance.-Establish and maintain a program of school library
51media services for all public schools in the district, including
52school library media centers, or school library media centers
53open to the public, and, in addition such traveling or
54circulating libraries as may be needed for the proper operation
55of the district school system.
56 Section 2. Subsection (4) of section 1006.40, Florida
57Statutes, is amended to read:
58 1006.40 Use of instructional materials allocation;
59instructional materials, library books, and reference books;
60repair of books.-
61 (4) The funds described in subsection (3) which district
62school boards may use to purchase materials not on the state-
63adopted list shall be used for the purchase of instructional
64materials or other items having intellectual content which
65assist in the instruction of a subject or course. These items
66may be available in bound, unbound, kit, or package form and may
67consist of hardbacked, or softbacked, or electronic textbooks,
68replacements for items which were part of previously purchased
69instructional materials, consumables, learning laboratories,
70manipulatives, electronic media, computer courseware or
71software, and other commonly accepted instructional tools as
72prescribed by district school board rule. Beginning with the
732012-2013 fiscal year, the funds available to district school
74boards for the purchase of materials not on the state-adopted
75list may not be used to purchase electronic or computer hardware
76unless even if such hardware is provided for the sole purpose of
77delivering instructional materials content in an electronic
78format. The funds provided for instructional materials bundled
79with software or other electronic media, nor may not such funds
80be used to purchase equipment or supplies. However, when
81authorized to do so in the General Appropriations Act, a school
82or district school board may use a portion of the funds
83available to it for the purchase of materials not on the state-
84adopted list to purchase science laboratory materials and
85supplies.
86 Section 3. This act shall take effect July 1, 2010.
