A bill to be entitled
2An act relating to career offenders; amending s. 775.261,
3F.S.; providing that it is a first-degree misdemeanor for
4a person to perform specified acts with the intent to
5assist a career offender in eluding a law enforcement
6agency that is seeking to find the career offender to
7question the career offender about, or to arrest the
8career offender for, his or her noncompliance; providing
9criminal penalties; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (10) is added to section 775.261,
14Florida Statutes, to read:
15 775.261 The Florida Career Offender Registration Act.-
16 (10) ASSISTING IN NONCOMPLIANCE.-It is a misdemeanor of
17the first degree, punishable as provided in s. 775.082 or s.
18775.083, for a person who has reason to believe that a career
19offender is not complying, or has not complied, with the
20requirements of this section and who, with the intent to assist
21the career offender in eluding a law enforcement agency that is
22seeking to find the career offender to question the career
23offender about, or to arrest the career offender for, his or her
24noncompliance with the requirements of this section, to:
25 (a) Withhold information from, or fail to notify, the law
26enforcement agency about the career offender's noncompliance
27with the requirements of this section and, if known, the
28whereabouts of the career offender;
29 (b) Harbor or attempt to harbor, or assist another in
30harboring or attempting to harbor, the career offender;
31 (c) Conceal or attempt to conceal, or assist another in
32concealing or attempting to conceal, the career offender; or
33 (d) Provide information to the law enforcement agency
34regarding the career offender which the person knows to be
35false.
36 Section 2. This act shall take effect July 1, 2010.
