    2         An act relating to public records; amending s.
    3         626.171, F.S.; providing an exemption from public
    4         records requirements for cellular telephone numbers
    5         relating to records of certain insurance-related
    6         licensures held by the Department of Financial
    7         Services; providing retroactive applicability;
    8         providing for future legislative review and repeal of
    9         the exemptions; providing a statement of public
   10         necessity; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (8) is added to section 626.171,
   15  Florida Statutes, to read:
   16         626.171 Application for license as an agent, customer
   17  representative, adjuster, service representative, or reinsurance
   18  intermediary.—
   19         (8)(a) Cellular telephone numbers collected by the
   20  department pursuant to subsection (2) are exempt from s.
   21  119.07(1) and s. 24(a), Art. I of the State Constitution. This
   22  exemption applies to cellular telephone numbers held by the
   23  department before, on, or after the effective date of the
   24  exemption.
   25         (b) This subsection is subject to the Open Government
   26  Sunset Review Act in accordance with s. 119.15 and shall stand
   27  repealed on October 2, 2029, unless reviewed and saved from
   28  repeal through reenactment by the Legislature.
   29         Section 2. The Legislature finds that it is a public
   30  necessity that all cellular telephone numbers collected by the
   31  Department of Financial Services pursuant to s. 626.171(2),
   32  Florida Statutes, be exempt from public records requirements.
   33  The Legislature finds that the unintentional publication of such
   34  information may subject the filer to identity theft, financial
   35  harm, or other adverse impacts. Without the public records
   36  exemption, the effective and efficient administration of the
   37  electronic filing system, which is otherwise designed to
   38  increase the ease of filing records, would be hindered. For
   39  these reasons, the Legislature finds that it is a public
   40  necessity to exempt such information from public records
   41  requirements.
   42         Section 3. This act shall take effect upon becoming a law.
