1                        A bill to be entitled 
2         An act relating to license plates; amending ss. 
3         320.08056 and 320.08058, F.S.; creating the Veterans 
4         of Foreign Wars license plate; establishing an annual 
5         use fee for the plate; providing for the distribution 
6         of use fees received from the sale of the plates; 
7         providing for the creation of a voucher program that 
8         provides for the presale of the plates; requiring that 
9         applicable fees be paid before a voucher is issued; 
10         requiring that a minimum number of voucher 
11         applications be submitted before the license plate is 
12         issued; providing an effective date. 
13 
14  Be It Enacted by the Legislature of the State of Florida: 
15 
16         Section 1. Paragraph (rrr) is added to subsection (4) of 
17  section 320.08056, Florida Statutes, to read: 
18         320.08056 Specialty license plates.— 
19         (4) The following license plate annual use fees shall be 
20  collected for the appropriate specialty license plates: 
21         (rrr)Veterans of Foreign Wars license plate, $25. 
22         Section 2. Subsection (70) is added to section 320.08058, 
23  Florida Statutes, to read: 
24         320.08058 Specialty license plates.— 
25         (70)VETERANS OF FOREIGN WARS LICENSE PLATES.— 
26         (a)The department shall develop a Veterans of Foreign Wars 
27  license plate as provided in this section. The plates must bear 
28  the colors and design approved by the department and must 
29  incorporate the Great Seal of the Veterans of Foreign Wars of 
30  the United States as described in Art. VIII, s. 801 of the 
31  Congressional Charter and By-Laws of the Veterans of Foreign 
32  Wars of the United States. The word “Florida” must appear at the 
33  top of the plate, and the words “Veterans of Foreign Wars” must 
34  appear at the bottom of the plate. 
35         (b) The department shall retain all revenues from the sale 
36  of such plates until all startup costs for developing and 
37  issuing the plates have been recovered. Thereafter, 100 percent 
38  of the annual use fees shall be distributed to Veterans of 
39  Foreign Wars, Department of Florida, and not less than 50 
40  percent of those fees shall be used to support the Voice of 
41  Democracy and Patriots’ Pen Scholarship programs and to support 
42  high school and college ROTC programs. 
43         (c) By January 1, 2011, the department shall establish a 
44  voucher program to issue vouchers to provide for the presale of 
45  the plate if an application fee of $10,000 is paid by the 
46  sponsor by December 1, 2010. 
47         (d) The processing fee as prescribed in s. 320.08056, the 
48  service charge and branch charge as prescribed in s. 320.04, and 
49  the annual use fee as prescribed in s. 320.08056 must be paid 
50  before a voucher is issued. All other applicable fees must be 
51  paid when the plates are issued. 
52         (e)If, within 24 months after the voucher program begins, 
53  a minimum of 1,000 voucher applications and required fees are 
54  submitted to the department, it shall begin issuing the plates. 
55  If this requirement is not met, the plate shall be automatically 
56  deauthorized, the department shall discontinue development of 
57  the plate and issuance of the presale vouchers, and shall notify 
58  purchasers of the vouchers that they may receive a refund of 
59  their deposit or use the deposit as a credit toward the purchase 
60  of any other specialty plate. 
61         Section 3. This act shall take effect July 1, 2010.
