1 A bill to be entitled
2 An act relating to anaphylaxis in public schools;
3 amending s. 1006.07, F.S.; requiring each district
4 school board to adopt an anaphylactic policy;
5 providing Department of Education responsibilities;
6 providing requirements for such policy; requiring a
7 certain percentage of specified school personnel to
8 receive certain training within a specified timeframe;
9 authorizing the State Board of Education to adopt
10 rules; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (12) is added to section 1006.07,
15 Florida Statutes, to read:
16 1006.07 District school board duties relating to student
17 discipline and school safety.—The district school board shall
18 provide for the proper accounting for all students, for the
19 attendance and control of students at school, and for proper
20 attention to health, safety, and other matters relating to the
21 welfare of students, including:
22 (12) ANAPHYLACTIC POLICY.—
23 (a) Each district school board must adopt an anaphylactic
24 policy for implementation at each school within the district.
25 (b) The policy must:
26 1. Meet the requirements established by State Board of
27 Education rule.
28 2. Be reviewed and, if necessary, updated at least every 3
29 years.
30 3. Be published on the school district’s website. The
31 department shall publish each district school board’s policy on
32 its website.
33 4. Include a procedure and treatment plan, including
34 emergency protocols and responsibilities for school nurses and
35 other appropriate school personnel, for responding to an
36 allergic reaction, including anaphylaxis.
37 5. Include training requirements for school personnel on
38 preventing and responding to an allergic reaction, including
39 anaphylaxis. The requirements for such training must include
40 training in the use of an epinephrine auto-injector. For
41 purposes of this paragraph, the term “school personnel” includes
42 employees providing care in before- and after-school programs at
43 schools within the district. At least 50 percent of school
44 personnel providing care in before- and after-school programs
45 must complete the training required by this subparagraph within
46 3 months after the date of employment. Completion of such
47 training must be documented in the school employee’s employment
48 file.
49 6. Include a procedure and guidelines for the development
50 of individualized emergency health care plans for students with
51 a food allergy or other allergy that could result in an allergic
52 reaction, including anaphylaxis.
53 7. Include a communication plan for:
54 a. The intake and dissemination of information regarding
55 students with a food allergy or other allergy, including a
56 discussion of methods, treatments, and therapies to reduce the
57 risk of an allergic reaction, including anaphylaxis.
58 b. Discussing with students, in a developmentally
59 appropriate manner, and parents information relating to safe and
60 unsafe foods for students with a food allergy and strategies to
61 avoid exposure to unsafe foods.
62 8. Include strategies for reducing the risk of exposure to
63 food allergens or other allergens that may cause an allergic
64 reaction, including anaphylaxis.
65 9. Include an annual notification to parents of enrolled
66 students that includes the anaphylactic policy and contact
67 information for school district employees who can provide
68 parents and students with further information.
69 (c) The State Board of Education may adopt rules to
70 administer this subsection.
71 Section 2. This act shall take effect July 1, 2023.
