Senate Education and Youth Committee offered the following substitute to SB
184:

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Part 7 of Article 17 of Chapter 2 of Title 20 of the Official Code of
Georgia Annotated, relating to termination, suspension, nonrenewal, demotion, or
reprimand of teachers and other school personnel, so as to provide requirements
for reduction in force policies; to provide for sanctions; to provide for
related matters; to provide for an effective date; to repeal conflicting laws;
and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Part
7 of Article 17 of Chapter 2 of Title 20 of the Official Code of Georgia
Annotated, relating to termination, suspension, nonrenewal, demotion, or
reprimand of teachers and other school personnel, is amended by adding a new
Code section to read as follows:
"20-2-948.
(a)
A local board of education shall not adopt or implement a policy that allows
length of service to be the primary or determining factor when implementing a
reduction in force. (b) Any policy adopted after the effective date of this
Code section that does not comply with subsection (a) of this Code section shall
be considered invalid and the State Board of Education shall be authorized to
take action to withhold all or any portion of state funds in accordance with
Code Section 20-2-243.
(c)
This Code section shall not apply if a local board of education eliminates an
entire program."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
