A BILL FOR AN ACT

 

 

relating to judiciary fees.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 601-17, Hawaii Revised Statutes, is amended to read as follows:

     "§601-17  Use of credit and debit cards to pay for court costs, fees, expenses, and other charges[.]; fee for credit, debit, and other electronic payments.  (a)  Costs, fees, bond forfeitures, fines, expenses, and other charges that are due and owing to the courts may be paid by use of credit cards or debit cards that are acceptable to the administrative director of the courts; provided that driver's license and vehicle registration clearances shall be paid by cash only.

     (b)  A service fee may be paid by the judiciary for the use of a credit or debit card service or other electronic payment service.  [In the event that] If a credit or debit card or other electronic payment service is used to pay any charges due and owing to the courts, the judiciary may impose an additional convenience fee on the user of the credit or debit card [user.] or electronic payment service.  The convenience fee collected from the user may be used by the judiciary to pay the service fee.  The amount of [such] the convenience fee shall not exceed [the amount of the service fee imposed on the judiciary for the subject] fifteen cents per credit or debit card or electronic payment transaction."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
