A BILL FOR AN ACT

 

 

RELATING TO WATER CONSERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 174C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§174C-    Water conservation rebate program.  (a)  There is established a water conservation rebate program.  Pursuant to section 174C-5(13), the commission may coordinate and contract with public water systems and utilities to implement the water conservation rebate program.  The total amount of rebates granted pursuant to this section shall not exceed $          in any calendar year.

     (b)  The commission shall:

     (1)  Prepare any forms that may be necessary to implement the rebate program, including issuing requests for proposals from public water systems and utilities describing their proposed rebate program;

     (2)  Require that public water systems and utilities furnish information documenting the total estimated amount of water conserved under the rebate program; and

     (3)  Prioritize annual rebates granted pursuant to this section for public water systems and utilities where state funds are matched or leveraged with non-state funds.

     (c)  Rebates granted pursuant to this section shall not support greater than fifty per cent of the cost of a newly constructed water conservation system and shall not exceed $1,000 per residential household per year and $5,000 per commercial entity for water conservation systems per year.

     (d)  As used in this section:

     "Public water system" has the same meaning as in section 340E-1.

     "Water conservation systems" means equipment and supplies used to construct or install a device that materially and predictably reduces potable water use or waste in a residential or commercial setting as determined by the commission.  The term may include rain barrels and cisterns, hot water circulation pumps, low-flow pre-rinse spray nozzles, soil moisture sensors as a component of an automatic irrigation system, air conditioning condensate capture, multi-unit water sub-meters, high efficiency toilets utilizing 1.28 gallons or less per flush, and other devices and apparatus as determined by the commission."

     SECTION 2.  The commission on water resource management shall:

     (1)  Review the water conservation system rebate program and determine the amount of non-state funds obtained as matching funds;

     (2)  Determine the impact of the rebate program on water conservation in terms of water saved; and

     (3)  Make a recommendation to the legislature on whether the rebate program should be extended or not.

The commission on water resource management shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2018.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2016-2017 for the water conservation rebate program.

     The sum appropriated shall be expended by the commission on water resource management for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050; provided that this Act shall be repealed on           .
