A BILL FOR AN ACT

 

 

relating to flood mitigation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The director of finance is authorized to issue general obligation bonds in the sum of $           or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2022-2023 for the purpose of the following capital improvement projects, referenced under Section 7.1 of volume I of the "Makaha Valley Flood Mitigation Study Final Report" dated December 2014:

1.   Eku stream channel and off-line detention basin

     Plans, design, and construction for improvements to Eku stream to extend the channel upstream 3,800 feet.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

2.   New Eku stream bridge at Farrington highway

     Plans, design, and construction for a new reinforced concrete bridge at Farrington highway crossing Eku stream.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of transportation.

3.   Noholio road drain line

     Plans, design, and construction for installation of a drain line on Noholio road with a closed culvert system.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

4.   Breach repair in the Makaha stream berm

     Plans, design, and construction for repair of the earthen berm at the breach.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

5.   Makaha stream levee

     Plans, design, and construction for a reinforced concrete levee (flood wall) system along the northern and western side of affected properties on Manuku and Nukea streets.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

6.   Kili drive channel

     Plans, design, and construction for a trapezoidal shaped, open concrete-lined ditch.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

7.   Mauna Olu Estates drainage improvements

     Plans, design, and construction for the Mauna Olu Estates drainage improvements project.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

8.   In-stream detention basins for Makaha stream

     Plans, design, and construction for the in-stream detention basins for Makaha stream project.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

9.   Restoration of Makaha surfing beach "pond"

     Plans, design, and construction for restoration of the "pond" at Makaha beach that served as a natural debris basin.

          Total funding                    $          

     The sum appropriated for this capital improvement project shall be expended by the department of land and natural resources.

     SECTION 2.  The appropriation made for the capital improvement projects authorized by section 1 of this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2024, shall lapse as of that date.

SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the following flood mitigation nonstructural measures, referenced under Section 7.2 of volume I of the "Makaha Valley Flood Mitigation Study Final Report" dated December 2014, as follows:

     (1)  $           for watershed restoration;

     (2)  $           for stream channel maintenance;

     (3)  $           for storm drain maintenance;

     (4)  $           for enforcement of existing legislation;

     (5)  $           for education on best management practices for watersheds; and

     (6)  $           for drainage improvements required for future development.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the following short-term flood mitigation projects, referenced under Section 5.2 of the "Final Lualualei Flood Mitigation Study for Lualualei, Waianae, Oahu, Hawaii" dated April 7, 2017, as follows:

     (1)  $           for the Māiliili stream watershed – channel cleaning at Kuwale, Puuhulu, and Pūhāwai Roads; and

     (2)  $           for channel cleaning at Ulehawa stream watershed – Hakimo Road, Paakea Road.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2022.
