A BILL FOR AN ACT

 

 

RELATING TO HEALTH CARE PROFESSIONALS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 325, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§325-    Continuing education; unique health issues.  (a)  Every health care professional identified pursuant to subsection (c) shall attend an annual continuing education course developed by the department of health on health issues that are unique to the State, which shall include reportable infectious diseases such as dengue fever, zika virus, chikungunya virus, leptospirosis, and rat lungworm disease.  The course shall focus on symptoms, diagnosis, testing, treatment, and reporting requirements.

     (b)  The continuing education requirement established under this section shall count toward the fulfillment of any continuing education requirements that are applicable to the health care professional; provided that the continuing education requirement established under this section shall meet or exceed any additional requirements for continuing education established for each health care professional.

     (c)  The director of health shall adopt rules pursuant to chapter 91 that identify the health care professional classes that shall be subject to the continuing education requirements of this section.  The director shall examine the following criteria in determining which health care professional classes should be subject to the continuing education requirements of this section:

     (1)  The scope of practice of the health care professional class;

     (2)  The likelihood and frequency that a practitioner within the health care professional class will treat an infectious and communicable disease identified in subsection (a); and

     (3)  The physical location and clinical setting of the practice of the health care professional class."

     SECTION 2.  Section 325-2, Hawaii Revised Statutes, is amended to read as follows:

     "§325-2  Physicians, laboratory directors, and health care professionals to report[.]; email address required.  (a) Every physician or health care professional having a client affected by or suspected of being affected by a disease or condition declared to be communicable or dangerous to the public health by the director of health shall report the incidence or suspected incidence of such disease or condition to the department of health in writing or in the manner specified by the department of health.  Every laboratory director having laboratory data regarding an individual affected by or suspected of being affected by a disease or condition declared to be communicable or dangerous to the public health shall report such diseases or conditions to the department of health in writing or in a manner specified by the health department.  Every physician, laboratory director, or health care professional who [refuses or neglects to give such notice, or make such report,] violates this section may be fined in an amount not to exceed $1,000 per violation, to be assessed by the director of health.  The director of health is authorized to impose the penalty pursuant to this section.

     (b)  Every laboratory director or health care provider as defined by section 11-156-2, Hawaii Administrative Rules, shall provide to the director a current electronic mail address that the director shall maintain in a database and utilize for the purpose of providing information collected pursuant to subsection (a) and for providing information to promote compliance with this section; provided that the electronic mail address provided to the director is the primary means of the laboratory director or health care provider to receive professional electronic mail correspondence.  The director shall be notified in writing or by electronic mail of any changes to or discontinuance of an electronic mail address provided by a laboratory director or health care provider under this section not later than thirty days following any such change or discontinuance."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2112.

Description:

Requires every laboratory director or health care provider, as defined, to provide the Director of Health with an electronic mail address for the purpose of enabling the Department of Health to provide public health information on communicable or dangerous diseases in the State.  Requires certain health care professional classes, as determined by the Director of Health, to attend an annual continuing education course developed by the Department of Health on health issues that are unique to the State.  (HB2233 HD2)
