A BILL FOR AN ACT

 

 

RELATING TO PAROLE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 353-14, Hawaii Revised Statutes, is amended to read as follows:

     "§353-14  Cash furnished discharged committed person, when.  (a)  Upon the discharge or parole of any committed person who has undergone a commitment or sentence of more than one year[,] and has been given appropriate resource referrals, the committed person may be furnished by the Hawaii paroling authority, in its discretion, with funds of not more than $200, to meet the committed person's immediate needs[.]; provided that legislative appropriations for this specific purpose have been authorized and allocated to the authority.  The expenditures made by the Hawaii paroling authority shall be included among the accounts for cost and maintenance of committed persons.

     (b)  The Hawaii paroling authority shall not use any funds appropriated pursuant to subsection (a) for any purpose other than to meet a committed person's immediate needs."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.



 

Report Title:

Parole; Legislative Appropriations; Discharged or Paroled Persons; Immediate Needs

 

Description:

Requires that committed persons be given appropriate resource referrals before being furnished with funds to meet the committed person's immediate needs by the Hawaii paroling authority at discharge or parole.  Specifies that funds furnished by the Hawaii Paroling Authority for discharged persons be subject to the availability of legislative appropriations authorized and allocated for that purpose.  Prohibits the Hawaii Paroling Authority from using funds appropriated for the purpose of providing for the immediate needs of discharged or paroled persons for any other purpose.  Takes effect 7/1/2050.  (SD1)
