A BILL FOR AN ACT

 

 

relating to emergency management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that, under article VIII, section 2, of the Hawaii State Constitution, county charters prevail over conflicting state statutes for the respective counties' executive, legislative, and administrative structure and organization.  Therefore, no statutorily granted power can suspend charter provisions on those subjects.

     Accordingly, the purpose of this Act is to expressly state, consistent with the Hawaii State Constitution, that charter provisions are not among the laws that may be suspended by a mayor when exercising authority under the emergency management statute.

     SECTION 2.  Section 127A-2, Hawaii Revised Statutes, is amended by amending the definition of "laws" to read as follows:

     ""Laws" includes ordinances, rules, regulations, and orders prescribed under federal, state, or county laws or ordinances and having the force and effect of law.  "Laws" does not include county charter provisions pertaining to county executive, legislative, and administrative structure and organization."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
