A BILL FOR AN ACT

 

 

RELATING TO THE ADVICE AND CONSENT OF THE SENATE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 26-31, Hawaii Revised Statutes, is amended to read as follows:

     "§26-31  Selection and terms of single executives as heads of departments[.]; selection of deputy directors and deputy chairs of departments.  (a)  Except as otherwise provided by the Constitution of the State or by this chapter, each principal department shall be headed by a single executive, who shall be nominated and, by and with the advice and consent of the senate, appointed by the governor, for a term to expire at the end of the term for which the governor was elected.  A vacancy occurring during a term shall be filled for the unexpired balance of the term, subject to the provisions of Article V, section 6 of the Constitution of the State.  The governor may remove a single executive from office at any time, except that the removal of the attorney general shall be subject to the advice and consent of the senate.

     (b)  Except as otherwise provided by the Constitution of the State or by this chapter, the deputy director and deputy chair of each principal department shall be nominated and, by and with the advice and consent of the senate, appointed by the governor, single executive of a principal department, or the chair of the board, commission, or other body."

     SECTION 2.  All principal departments who had a deputy director or deputy chair appointed with the advice and consent of the senate as required by section 1 of this Act shall report to the legislature prior to the regular session of 2026 on the effectiveness of the process established by section 1 of this Act.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2112, and shall be repealed on June 30, 2026; provided that section 26-31, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day before the effective date of this Act.

State Departments; Deputy Directors; Deputy Chairs; Senate Advice and Consent

 

Description:

Requires nominees for the position of deputy director and deputy chair of principal departments to be subject to advice and consent of the senate.  Requires a report to the legislature on the effectiveness of the senate advice and consent process for the appointment of deputy directors and deputy chairs.  Repeals 6/30/2026.  Effective 7/1/2112.  (HD1)
