A BILL FOR AN ACT

 

 

relating to golf carts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291C-134, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§291C-134[]]  Neighborhood electric vehicles; golf carts; speed; restrictions.  (a)  A neighborhood electric vehicle or golf cart shall not be operated at a speed of more than twenty-five miles per hour.

     (b)  A neighborhood electric vehicle or golf cart shall not be driven on a highway that has a posted speed limit of more than [thirty-five] twenty-five miles per hour.  This subsection does not prohibit a neighborhood electric vehicle from crossing a highway that has a posted speed limit of more than [thirty-five] twenty-five miles per hour at an intersection.

     (c)  A neighborhood electric vehicle or golf cart shall have a notice of the operational restrictions applying to the vehicle permanently attached to or painted on the vehicle in a location that is in clear view of the driver.

     (d)  A neighborhood electric vehicle or golf cart shall operate only during daylight hours unless equipped with headlights.

     (e)  Except as provided in this section, this chapter shall apply to the operation of any neighborhood electric vehicle or golf cart.

     (f)  A neighborhood electric vehicle or golf cart operating in violation of this section may be confiscated at the time of the violation by the respective county police department.

     [[(d)]] (g)  The director of transportation shall adopt rules pursuant to chapter 91 as may be necessary to regulate the use of neighborhood electric vehicles."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Golf Carts; Neighborhood Electric Vehicles; Prohibition; Restrictions

 

Description:

Prohibits golf carts from operating at a speed greater than twenty-five miles per hour.  Prohibits neighborhood electric vehicles and golf carts from being driven on highways with a posted speed limit greater than twenty-five miles, except for crossing an intersection at a highway with a posted speed limit greater than twenty-five miles.  Restricts operation of neighborhood electric vehicles or golf carts to daylight hours unless the vehicle is equipped with headlights.  Authorizes county police departments to confiscate neighborhood electric vehicles or golf carts at the time of violation.
