A BILL FOR AN ACT

 

 

relating to selective service.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature recognizes that sufficient armed strength must be achieved and maintained to insure the security of the United States.  In a free society, the obligations and privileges of serving in the armed forces and the reserve components should be shared in accordance with a system of selection that is fair and just, and consistent with maintaining an effective national economy.

     The legislature finds that to achieve these national security goals, the United States Congress has enacted the United States Military Selective Service Act (50 U.S.C. App. 451 et seq.), which requires all male citizens and males residing in the United States, except for lawfully admitted non-immigrants, to register with the Selective Service System upon reaching the age of eighteen.

     The legislature further finds that any person who is not in compliance with the Military Selective Service Act is ineligible for federal student financial assistance and employment within the executive branch of the federal government.

     The purpose of this Act is to require compliance with the Military Selective Service Act to be eligible for enrollment in a state-supported post-secondary institution, qualify for state financial assistance for post-secondary education, or be eligible for state or county employment or service.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

SELECTIVE SERVICE REGISTRATION AWARENESS AND COMPLIANCE ACT

     §   -1  Short title.  This chapter shall be known as the "Selective Service Registration Awareness and Compliance Act".

     §   -2  Definitions.  As used in this chapter:

     "Military Selective Service Act" means 50 United States Code App. 451 et seq.

     §   -3  Compliance; post-secondary education enrollment and financial assistance.  (a)  Notwithstanding any law to the contrary, any person who is not in compliance with the Military Selective Service Act shall not be:

     (1)  Permitted to enroll in, or receive education from, a state-supported post-secondary institution, including a university, college, community college, professional school, research facility, education center, or institution within the University of Hawaii system; and

     (2)  Eligible to receive a loan, grant, scholarship, or other financial assistance for post-secondary education that is provided by, supported by, or guaranteed by the State.

     (b)  The University of Hawaii shall ensure that applicants and enrollees under its jurisdiction comply with the Military Selective Service Act for the purposes of this section.

     §   -4  Compliance; state and county employment and service.  (a)  Notwithstanding any law to the contrary, male citizens of the United States and other males residing in the United States who are eighteen years of age and older and less than twenty-six years of age, who are not in compliance with the Military Selective Service Act, shall not be eligible for employment by the State or any political subdivision of the State and shall not be eligible for service for the State or any political subdivision of the State including all offices, self-governing bodies, boards and commissions, departments, agencies, institutions, and instrumentalities.

     (b)  The State and respective counties shall ensure that employees under their jurisdiction comply with the Military Selective Service Act for the purposes of this section.

     §   -5  Exceptions.  A person shall not be denied a right, privilege, or benefit under this chapter for noncompliance with the Military Selective Service Act if the person is:

     (1)  Under eighteen years of age or twenty-six years of age and older;

     (2)  In the armed forces of the United States on active duty, other than in a reserve or National Guard unit or has already served in the armed forces or has a condition that would preclude acceptability for military service;

     (3)  Neither a United States citizen nor a resident immigrant;

     (4)  A permanent resident of the Trust Territory of the Pacific Island or the Northern Mariana Islands; or

     (5)  Is excused from registration for some other reason provided by the Military Selective Service Act and that reason is included in a written statement.

     §   -6  Severability.  If any provision of this chapter, or the application thereof to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the chapter which can be given without the invalid provision or application, and to this end the provisions of this chapter are severable."

     SECTION 3.  Section 249-9.2, Hawaii Revised Statutes, is amended to read as follows:

     "§249-9.2  Special number plates; military service[.] and selective service.  (a)  In lieu of the number plates contracted on behalf of the counties by the director of finance of the city and county of Honolulu, the director of finance shall provide, for a fee, one set of special number plates upon the receipt of an application together with:

     (1)  Specific proof that the applicant was awarded the Purple Heart by the United States Department of Defense for wounds received in military or naval combat against an armed enemy of the United States;

     (2)  Certification that the applicant is a veteran;

     (3)  Specific proof that the applicant was serving the United States in the military or as a civilian, on Oahu, or offshore at a distance of not more than three miles at the time of the December 7, 1941, attack on Pearl Harbor.  Certification from the Hawaii state chairperson of the Pearl Harbor Survivors Association shall constitute sufficient proof;

     (4)  Specific proof that the applicant was confined as a prisoner of war while providing military service to the United States;

     (5)  Certification from the United States Department of Veterans Affairs or the state office of veterans' services that the applicant is a combat veteran or a veteran of the Vietnam conflict, the Korean conflict, World War II, or the Persian Gulf conflict; [or]

     (6)  Specific proof that the applicant would qualify for a gold star lapel button under the criteria established by title 10 United States Code section 1126; provided that the applicant shall not be disqualified for the special number plates because the applicant is the grandparent of the deceased member of the United States armed forces; or

     (7)  Certification by the Hawaii state director of the United States Selective Service System that the applicant is either:

         (A)  A member of a Hawaii selective service local board; or

         (B)  The Hawaii state director of the United States Selective Service System;

provided that applicants, except civilian applicants under paragraph (3) and civilian applicants and applicants who are currently serving the United States in the military under paragraph (6), shall also provide a copy of the applicant's most recent discharge paper or separation document that indicates an honorable discharge or general (under honorable conditions) discharge from active duty.

     (b)  The design of the plates for:

     (1)  Purple heart recipients shall include the words "COMBAT WOUNDED";

     (2)  Veterans shall include the word "VETERAN";

     (3)  Pearl Harbor survivors shall include the words "PEARL HARBOR SURVIVOR";

     (4)  Former prisoners of war shall include the words "FORMER PRISONER OF WAR";

     (5)  Combat veterans shall include the words "COMBAT VETERAN";

     (6)  Veterans of the Vietnam conflict shall include the words "VIETNAM VETERAN";

     (7)  Veterans of the Korean conflict shall include the words "KOREA VETERAN";

     (8)  Veterans of World War II shall include the words "WORLD WAR II VETERAN";

     (9)  Veterans of the Persian Gulf conflict shall include the words "PERSIAN GULF VETERAN"; [and]

    (10)  Gold star family members, including grandparents, shall include the words "GOLD STAR FAMILY"[.];

    (11)  Members of Hawaii state selective service local boards shall include the words "SELECTIVE SERVICE BOARD MEMBER"; and

    (12)  The Hawaii state director of the United States Selective Service System shall include the words "SELECTIVE SERVICE STATE DIRECTOR".

     These designations shall be imprinted on the left side of the license plates in a manner similar to congressional and honorary consul license plates.

     (c)  Registration certificates and license plates issued under this section shall not be transferable to any other person.  Special number plates for military or selective service shall be assigned to a noncommercial passenger motor vehicle, a noncommercial motorcycle, or motor scooter registered in the name of the qualified applicant and shall be available in any category of special number plates for military or selective service.  Prior to the transfer of the ownership of the qualified person's vehicle to another party, the special number plates shall be surrendered to the director of finance as a condition to the issuance of replacement special number plates; provided that the director of finance shall allow the survivor of the qualified person, upon request, to retain the front special number plate as a memorial.

     (d)  The director of finance shall authorize the design of a license plate that is readily identifiable and distinguishable under actual traffic conditions and shall adopt rules pursuant to chapter 91 to carry out this section."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
