A BILL FOR AN ACT

 

 

RELATING TO CAMPAIGN CONTRIBUTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that to enhance public trust in government, steps should be taken to deter allegations concerning potential conflicts of interest in the legislative process.  Specifically, the legislature finds that registered lobbyists who lobby the legislature should be regulated more stringently to reduce situations where actual or perceived conflicts of interest may be raised.

     The legislature further finds that allowing registered lobbyists to make contributions to the governor, lieutenant governor, or members of the legislature during the regular or special legislative session is particularly vexing to the maintenance of a healthy democratic process.  Allowing such conduct provides the opportunity for corruption, and at the very least harms public perception of state government by giving the appearance of corruption.  To preserve public trust, and ensure state government serves the people of this State and not corporate interests, the legislature further finds it vital to provide clear and strict policies regarding the contributions of registered lobbyists to prevent corruption or the appearance of corruption in state government.

     Accordingly, the purpose of this Act is to prohibit registered lobbyists who lobby the legislature from making a contribution to the governor, lieutenant governor, and members of the legislature while the legislature is in session.

     SECTION 2.  Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to part XIII to be appropriately designated and to read as follows:

     "§11-     Restricted campaign contributions.  (a)  No registered lobbyist that lobbies the legislature shall make a contribution to:

     (1)  The governor;

     (2)  The lieutenant governor; or

     (3)  A member of the legislature,

when the legislature is convened in regular or special session.

     (c)  This section shall not affect the requirements of section 84-11.

     (d)  For purposes of this section:

     "Contribution" does not include any gifts of flowers, food, or other items customarily given during the course of a legislative session.

     "Registered lobbyist" means any lobbyist required to register with the state ethics commission pursuant to section 97-2."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
