A BILL FOR AN ACT

 

 

RELATING TO SOLID WASTE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State should lead by example while moving toward a more environmentally sustainable future.  An effective way to accomplish increased environmental sustainability is to diminish the need for landfills by diverting food and green waste from landfills to composting and energy production.

     The purpose of this Act is to continue the progress to long-term environmental sustainability by authorizing the Hawaii public housing authority to enter into contracts with private businesses to remove food and green waste from the waste stream for use in other business sectors, including agriculture and energy generation.

     SECTION 2.  Section 356D-4, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The authority may:

     (1)  Sue and be sued;

     (2)  Have a seal and alter the same at pleasure;

     (3)  Make and execute contracts and other instruments necessary or convenient to the exercise of its powers[;], which may include contracts with private businesses to remove "food waste" and "green waste", as those terms are defined in section 342G-1, from public housing projects; and

     (4)  Adopt bylaws and rules in accordance with chapter 91 for its organization, internal management, and to carry into effect its purposes, powers, and programs."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2100.
