A BILL FOR AN ACT

 

 

RELATING TO PESTICIDES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to better address the potential public health and environmental issues related to pesticide use by identifying trends in pesticide use.

     SECTION 2.  Chapter 149A, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   .  PESTICIDE USE

     §149A-   Pesticide use reporting.  (a)  The department shall publish, in an annual report no later than July 1 of the year immediately following the year for which the data was collected, a summary of restricted use pesticide use in the State.  The summary shall include:

     (1)  A list of all restricted use pesticides used in each county in the State by type and volume, excluding pesticides defined in FIFRA, 40 Code of Federal Regulations Section 152.25(f), as minimum risk pesticides;

     (2)  A summary of health complaints related to restricted use pesticide use reported to the department;

     (3)  An analysis of trends in restricted use pesticide use;

     (4)  An assessment of the accuracy of the reported restricted use pesticide use data;

     (5)  An accounting of the amount and type of restricted use pesticides imported into the State and the amount and type of restricted use pesticides reported as being used in the State; and

     (6)  Recommendations on how state agencies and private entities can better work together to address restricted use pesticide use and related health and environmental concerns, including how to collect and provide better data and information, how to streamline any related government responsibilities, and suggestions for improving the safety of the current use of all pesticides.

     (b)  The department shall categorize restricted use pesticide use reported under subsection (a) using the following categories:

     (1)  Agriculture;

     (2)  Forestry; and

     (3)  Publically funded use, which shall include schools, roadsides, public parks, landscaping, and pest control for all public buildings.

     (c)  The department shall permit an independent review of the restricted use pesticide use collection procedures implemented in accordance with this part, as deemed necessary to ensure accuracy, reliability, and validity of the data collected.

     §149A-   Information by request of abutting property owner.  At the written request of an abutting property owner, any private or commercial pesticide applicator, including private or commercial pesticide applicators employed by the State, shall report to the requesting property owner information regarding the use of pesticides, including:

     (1)  The name of the applicator and pesticide application license number;

     (2)  The location of the pesticide use, including the address, zip code, and description of area, or the geographic information systems coordinates, if necessary;

     (3)  The brand name, common name, chemical name, and the EPA registration number for the pesticide;

     (4)  The quantity of pesticide applied, including any mixture amounts of pesticides applied;

     (5)  The target species and threshold that required treatment, purpose of pesticide application, and type of site for the application;

     (6)  The weather conditions, including wind speed, at the time and date of application; and

     (7)  Any other data required by the department for purposes of this part.

     §149A-   Fees.  The department may implement a pesticide use reporting fee for cost recovery for this part."

     SECTION 3.  By January 1, 2014, the department of agriculture shall adopt rules pursuant to chapter 91, Hawaii Revised Statutes, to implement this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.



 

Report Title:

Pesticide Use Reporting; Fee

 

Description:

Requires the Department of Agriculture (DOA) to annually report on restricted use pesticides in the State.  Establishes a system by which concerned neighbors can request reports from pesticide applicators and sets out minimum requirements.  Permits DOA to impose a fee to recover costs of the program.  Effective July 1, 2050.  (HB673 HD1)
