A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 286-26, Hawaii Revised Statutes, is amended by amending subsections (a) and (b) to read as follows:

     "(a)  The following vehicles shall be certified as provided in subsection (e) once every year:

     (1)  Trucks, truck-tractors, semitrailers, and pole trailers having a gross vehicle weight rating of more than 10,000 pounds;

     (2)  Buses;

     (3)  Rental or U-drive motor vehicles two years of age or older;

     (4)  Taxicabs; and

     (5)  Mopeds.

Ambulances shall be certified as provided in subsection (e) once every six months.  Motorcycles shall be certified as provided in subsection (e) once every two years.

     (b)  All other vehicles, including [motorcycles,] mopeds, trailers, semitrailers, and pole trailers having a gross vehicle weight rating of 10,000 pounds or less, and antique motor vehicles as defined in section 249-1, except those in subsections (c) and (d), shall be certified as provided in subsection (e) every twelve months; provided that any vehicle to which this subsection applies, except a moped, shall not require inspection within two years of the date on which the vehicle was first sold."

     SECTION 2.  The director of transportation shall:

     (1)  Adopt rules pursuant to chapter 91, Hawaii Revised Statutes, to require motor vehicle inspectors to charge an inspection fee of no less than $25 for motorcycles; and

     (2)  Waive or extend the renewal, expiration, or other deadlines for certificates of inspections for motorcycles in accordance with section 3 of this Act.

     SECTION 3.  Beginning on the effective date of this Act and ending two years after the effective date of this Act, section 286-26, Hawaii Revised Statutes, and any administrative rules adopted thereunder shall be suspended only to the extent necessary to enable the director of transportation to waive or extend the renewal, expiration, or other deadlines for certificates of inspection for any motorcycle affected by this Act.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on June 30, 3000.

Description:

Requires that motorcycles receive safety inspections once every 2 years instead of once every 12 months.  Requires the director of transportation to adopt rules to increase to $25 the inspection fee for motorcycles.  Establishes a 2-year moratorium on motorcycle certificates of inspection requirements.  Effective 6/30/3000.  (HD1)
