A BILL FOR AN ACT

 

 

Relating to Training.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  In recognition of the State's constitutional and statutory obligation to protect the traditional and customary rights of native Hawaiians, the legislature passed Act 169, Session Laws of Hawaii 2015, which directed the office of Hawaiian affairs to create and administer a training course on native Hawaiian and Hawaiian rights.  Specifically, Act 169 required members of certain boards and commissions whose roles directly affected native Hawaiian rights to participate in the training course, thereby ensuring that the members would possess the appropriate knowledge required to properly execute their duties.  Upon completing the course, members of these boards and commissions would be educated of their lawful obligations, and understand how infringement of those obligations would affect native Hawaiian and Hawaiian people.

     Act 169 allows, but does not require, heads of state and county departments to attend these trainings.  The legislature finds that it is appropriate for these individuals, as chief executive officers of their respective state and county agencies, to be required to receive this training.

     Therefore, the purpose of this Act is to require the heads of all state and county departments to take the training course prescribed by Act 169.

     SECTION 2.  Chapter 10, Hawaii Revised Statues, is amended by amending the title of part III to read as follows:

     "[[]PART III.[]]  TRAINING; STATE AND COUNTY DEPARTMENT HEADS; CERTAIN BOARDS, COMMISSIONS, AND COUNCILS; NATIVE HAWAIIAN AND HAWAIIAN TRADITIONAL AND CUSTOMARY RIGHTS, NATURAL RESOURCE PROTECTION AND ACCESS RIGHTS, AND THE PUBLIC TRUST"

     SECTION 3.  Section 10-41, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The training required by this part shall apply to all state and county department heads and members of the land use commission, board of land and natural resources, commission on water resource management, environmental council, board of directors of the agribusiness development corporation, board of agriculture, legacy land conservation commission, natural area reserves system commission, Hawaii historic places review board, and board of health."

     SECTION 4.  Section 10-42, Hawaii Revised Statutes, is amended to read as follows:

     1.  By amending subsection (a) to read:

     "(a)  All state and county department heads and council, board, and commission members identified in section 10-41(a) shall complete the training course administered by the office of Hawaiian affairs pursuant to this section within twelve months of the date of the member's initial appointment."

     2.  By amending subsection (c) to read:

     "(c)  The office of Hawaiian affairs, at its own expense, shall develop the methods and prepare any materials necessary to implement the training course, administer the training course, and notify each state or county department head, council, board, and commission identified in section 10-41(a) that attendance in a training course is mandatory."

     3.  By amending subsection (e) to read:

     "(e)  The governor and mayor of each county shall provide to the office of Hawaiian affairs the names of persons required to take the training course pursuant to this part within thirty calendar days of their initial appointment by the governor[.] or mayor."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval.
