HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of health and department of public safety to convene a task force to develop a plan for the design, development, construction, and operation of a secure forensic facility.

 

 


     WHEREAS, the Director of Health and Director of Public Safety have individuals in their custody who require mental health or other specialized services; and

 

     WHEREAS, some of the individuals committed to the custody of the Director of Health may require stricter security than is typically provided in a general psychiatric facility such as the Hawaii State Hospital; and

 

     WHEREAS, the Department of Health and Department of Public Safety may benefit from the joint planning and development of a secure forensic facility that would meet the special safety and treatment needs of certain individuals in their custody; and

 

     WHEREAS, a secure forensic facility may be the most cost effective way to address the general public's security concerns and provide improved mental health services to individuals in the custody of the Director of Health and the Department of Public Safety; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, the Senate concurring, that the Department of Health and Department of Public Safety are requested to convene a task force to develop a plan for the design, development, construction, and operation of a secure forensic facility; and

 

     BE IT FURTHER RESOLVED that the task force consists of:

 

     (1)  A representative from the Office of the Governor;

 

     (2)  A state Circuit Court Judge to be selected by the Chief Justice of the Hawaii Supreme Court;

 

     (3)  A representative from the Department of the Attorney General;

 

     (4)  The Director of Health, or the Director's designee, who shall serve as co-chair of the task force;

 

     (5)  The Director of Public Safety, or the Director's designee, who shall serve as co-chair of the task force;

 

     (6)  A representative from the Department of Accounting and General Services;

 

     (7)  A representative from the Office of the Public Defender;

 

     (8)  A representative from the Office of the Prosecuting Attorney of the City and County of Honolulu;

 

     (9)  A representative from the Office of the Prosecuting Attorney of the County of Hawaii;

 

    (10)  A representative from the Office of the Prosecuting Attorney of the County of Kauai; and

 

    (11)  A representative from the Office of the Prosecuting Attorney of the County of Maui; and

 

     BE IT FURTHER RESOLVED that in planning for the design, development, construction, and operation of a secure forensic facility the task force examine ways to address the needs of individuals committed to the custody of the Director of Health who may require strict security and individuals committed to the custody of the Director of Public Safety who require intensive mental health treatment, and whether the needs of these groups of individuals may be more effectively addressed in different settings; and

 

     BE IT FURTHER RESOLVED that the chairs of the task force may invite other individuals to provide information and participate in task force discussions to further the purposes of the task force; and

 

     BE IT FURTHER RESOLVED that the task force report its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, Chief Justice of the Hawaii Supreme Court, Attorney General, Director of Health, Director of Public Safety, Comptroller, Public Defender, Prosecuting Attorney of the City and County of Honolulu, Prosecuting Attorney of the County of Hawaii, Prosecuting Attorney of the County of Kauai, and Prosecuting Attorney of the County of Maui.
