A BILL FOR AN ACT

 

 

relating to wages.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 104, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§104-    Prevailing wage enforcement special fund.  (a)  There is created within the state treasury and to be administered by the department, the prevailing wage enforcement special fund, into which shall be transferred one tenth of one per cent of the total amount of each contract subject to part I.

     (b)  The prevailing wage enforcement special fund shall be used by the department solely for enforcing compliance with this chapter, including increasing the number of department personnel for inspections and investigations.

     (c)  The one tenth of one per cent amount shall be calculated at the time a governmental contracting agency enters into a contract with a contractor that is subject to this chapter.  The one tenth of one per cent amount shall be calculated by the governmental contracting agency and transferred into the prevailing wage enforcement special fund within thirty days of the execution of the contract.

     (d)  The comptroller shall:

     (1)  Provide each governmental contracting agency information regarding contracts and amounts that shall be included or excluded from the one tenth of one per cent amount;

     (2)  Ensure that each governmental contracting agency calculates its one tenth of one per cent amount correctly; and

     (3)  Ensure that each governmental contracting agency transfers the correct amount to the prevailing wage enforcement special fund in a timely manner.

     (e)  The comptroller and the director shall keep records of amounts due from each governmental contracting agency under the one tenth of one per cent requirement as provided in this section."

     SECTION 2.  This Act shall not apply to any contract executed prior to its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2011.
