A BILL FOR AN ACT

 

 

Relating to transit-oriented Development.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State has a unique opportunity to address economic diversification and affordable housing shortages through transit-oriented development.  However, despite being the largest landowner alongside the rail transit stations, the State has yet to formulate a master plan to develop these parcels so they are transit-ready.  In preparation for the completion of phases one and two of the Honolulu rail transit project, the State must maximize the opportunities for development of land around rail stations, thereby supporting the local economy, improving access to transportation, and increasing rail ridership.

     The purpose of this Act is to create an agency to facilitate, oversee, and expedite transit-oriented development of public lands around the rail stations.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

Transit-Oriented Development

     §   -1  Definitions.  Unless the context clearly requires a different meaning, when used in this chapter:

     "Office" means the office of transit-oriented development.

     "Transit-oriented development" means development of public lands within a half mile radius of a rail transit station.

     §   -2  Office of transit-oriented development.  (a)  There is established within the office of the governor, on a special and temporary basis, the office of transit-oriented development.

     (b)  Except as otherwise provided by law, the office shall:

     (1)  Manage and prioritize resources for transit-oriented development.  This shall include but not be limited to developing a program for establishing transit-oriented development funding sources through investments, monitoring and acting upon federal grant opportunities for transit-oriented development of affordable housing and workforce rental units, and compiling existing transit-oriented development funding sources;

     (2)  Develop a process for the implementation of transit-oriented development by defining the solicitation process.  To this end, the office shall identify potential sites for development or redevelopment of public lands, establish joint development procedures, and test a community planning tool tailored to Hawaii's needs based upon the "Twin Cities Region Equitable Development Principles and Scorecard";

     (3)  Effectively communicate the progress made in transit-oriented development by tracking all development projects within a half mile radius of rail transit stations, producing and publishing annual transit-oriented development reports, and developing relationships with major transit-oriented development stakeholders to facilitate input and feedback on transit-oriented development projects.  The office shall also communicate with county transit-oriented development points of contact and report on policy implementation at the county level;

     (4)  Collaborate with partners and seek expertise on transit-oriented development projects by convening advisory groups as needed to advise the office on specific development issues, and providing guidance to developers regarding best practices for transit-oriented development and integrating rail into development projects;

     (5)  Conduct research and market analyses to determine the best revenue-generating programs for public lands in order to better guide the solicitation process;

     (6)  Enter into public-private agreements, as appropriate, to execute plans for transit-oriented development; and

     (7)  Provide leadership for development, redevelopment, financing, and enhancement of selected transit-oriented development projects.

     §   -3  Office of transit-oriented development; director.  The head of the office shall be known as the director of the office of transit-oriented development.  The director shall be appointed by the governor pursuant to section 26-34, and shall oversee and execute the duties of the office."

     SECTION 3.  This Act shall take effect upon its approval and shall be repealed on June 30, 2022.
