     (b)  The director may authorize the sale of diesel fuel that does not meet the provisions of this section if:

     (1)  Sufficient quantities of competitively-priced biodiesel produced in the State are not available to meet the requirements of this section; or

     (2)  The director determines that compliance with this section would cause undue hardship.

     (1)  The price and amount of biodiesel available;

     (2)  The amount of biodiesel-blended fuel sold by the distributor;

     (e)  Any distributor or any other person who violates this section shall be subject to a fine of not less than $2 per gallon of nonconforming fuel, up to a maximum of $10,000 per infraction.

     (f)  As used in this section, "biodiesel" means a vegetable oil-based fuel that meets ASTM International standard D6751, "Standard Specification for Biodiesel (B100) Fuel Blend Stock for Distillate Fuels", as amended."
