A BILL FOR AN ACT

 

 

RELATING TO IDENTIFICATION CARDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 286-306, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Every identification card issued under this part, whether an original or a renewal, shall bear an expiration date that shall be the date and month of the individual's birthday eight years after the year of issuance; provided that if the individual is a legal nonimmigrant, the certificate shall bear an expiration date that is the same as the expiration date on the individual's arrival-departure record, CBP Form I-94.  A cardholder may renew the cardholder's identification card within six months before the day on which it expires by filing an application in accordance with section 286-303 and paying the prescribed fee [establish] established by rules of the director."

     SECTION 2.  Section 286-308, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  A cardholder who, after receiving an identification card, has a change in one or more of the following:

     (1)  Name, legally changed by marriage, divorce, adoption, legitimization, order of the lieutenant governor, or other legal means;

     (2)  Citizenship status;

     (3)  Address; or

     (4)  Individual in charge of the cardholder (in the case of a minor or incompetent individual),

within thirty days after the change, shall report the change, submit supporting documents, and present the cardholder's identification card to the examiner.  The examiner of drivers, upon being furnished with satisfactory proof as to the change, and receiving payment of the fee, if applicable, shall cancel the identification card and issue a new identification card bearing the new name, citizenship status, or address of the cardholder, making appropriate notation of the facts upon the records of the examiner."

     SECTION 3.  Section 286-309, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§286-309[]]  Rules.  (a)  For the purpose of carrying out this part, the director, pursuant to chapter 91, shall adopt rules including rules assessing reasonable fees for the services provided under this part.

     (b)  The rules shall authorize the examiner of drivers to waive any fee in cases of extreme hardship and provide criteria for determining whether a waiver is warranted[.]; provided that the rules shall direct the examiner of drivers to waive entirely any fee for the issuance of:

     (1)  An original or renewal identification card; or

     (2)  A new identification card as a result of an error correction or change pursuant to section 286-306(b),

to a qualified individual who is homeless, subject to verification of the homeless status of the individual by official letter from a homeless services provider; provided further that the homeless services provider shall permit the homeless individual to use the homeless service provider's address to the extent necessary to satisfy the requirements of applicable federal law.  The rules may authorize the examiner of drivers to waive fees for the issuance of identification cards to qualified individuals who are homeless under circumstances such as the loss, destruction, theft, or mutilation of an identification card, subject to conditions imposed by the director through rules.

     (c)  The rules shall require that the following information be collected from the individual in each instance that the fee for the issuance of an identification card is waived due to a person's homeless status:

     (1)  The reason the individual no longer has identification;

     (2)  The examiner of drivers' location from which the application for a fee waiver was submitted;

     (3)  The name of the homeless services agency providing an official letter verifying the individual's homeless status; and

     (4)  The number of times each homeless services agency requests a fee waiver for a homeless individual."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on January 5, 2016.

Requires a fee waiver for the issuance of a civil identification card in certain cases for a person who is homeless, provided homeless status is verified with an official letter.  Mandates the examiner of drivers to collect data in instances in which fee waivers are granted due to a person's homeless status.  Takes effect on 1/5/2016.  (SD1)
