A BILL FOR AN ACT

 

 

RELATING TO THE GLASS ADVANCE DISPOSAL FEE PROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that since the enactment of chapter 342G, part VII, Hawaii Revised Statutes, glass container recovery, there have been no staff positions requested to administer the glass advance disposal fee program established by that law.  The lack of requests for positions was due to the uncertain interpretation of certain statutory provisions and the perceived lack of authority to develop and adopt rules for the program.  As a result, glass recycling in Hawaii has been limited and ineffective.

     The legislature further finds that the state auditor recommended in report numbers 14-16 and 17-04 that the department of health request positions for the program from the legislature to adequately administer and clarify the glass advance disposal fee program.

     The purpose of this Act is to appropriate funds to establish two positions for the glass advance disposal fee program.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 for two full-time equivalent (2.0 FTE) positions for the glass advance disposal fee program, which shall be allocated as follows:

     (1)  $         for one full-time equivalent (1.0 FTE) environmental health specialist IV position; and

     (2)  $         for one full-time equivalent (1.0 FTE) planner IV position.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act shall take effect on January 28, 2045.
