A BILL FOR AN ACT

 

 

relating to the military.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the state department of defense for administrative purposes the advisory council for sexual trauma in the Hawaii national guard.  The council shall:

     (1)  Review best practices for the prevention of and response to sexual assault and sexual harassment within a military environment including best practices for assisting state law enforcement with the prosecution of offenders;

     (2)  Compile a directory of resources available to assist victims of sexual assault or sexual harassment who are current or former members of the Hawaii national guard;

     (3)  Make recommendations for a financial assistance program for current and former members of the Hawaii national guard who were victims of sexual assault or sexual harassment while members of the Hawaii national guard and who are involved in state or civil court proceedings related to the sexual assault or sexual harassment to cover their traveling expenses from their participation in those proceedings; and

     (4)  Work with sexual abuse or sexual harassment organizations for the provision of advocacy and support services to members of the Hawaii national guard and their family members who are victims of sexual assault or sexual harassment;

     (b)  The council shall consist of the following members:

     (1)  The adjutant general who shall serve as the chair of the council;

     (2)  A representative from the department of the attorney general;

     (3)  A representative from the department or office of the prosecuting attorney for each county;

     (4)  A representative from each of the county police departments;

     (5)  A representative from the judiciary;

     (6)  A representative from the Hawaii national guard; and

     (7)  Representatives from sexual assault or sexual harassment organizations, to be invited by the chair.

     (c)  The members of the council shall serve without compensation but shall be reimbursed for reasonable expenses, including travel expenses, in the performance of their duties on the council.

     (d)  No later than twenty days prior to the convening of the regular session of 2025 and each regular session thereafter, the council shall submit a report to the legislature that shall include:

     (1)  Data relating to all reported incidents of sexual assault and sexual harassment within the Hawaii national guard in each of the preceding ten years including information on the current status of victims and the outcome of any state or federal criminal proceedings arising out of those incidents to the extent that the sharing of that data and information is not prohibited by federal law and can be presented in a way that does not identify and cannot be used with other information to identify any victim of sexual assault or sexual harassment;

     (2)  A description of all sexual assault and sexual harassment prevention training provided to members of the Hawaii national guard in the preceding year;

     (3)  A description of the current practices and procedures for the prevention of sexual assault and sexual harassment and investigation of and disciplinary actions taken in response to reports of sexual assault and sexual harassment in the Hawaii national guard; and

     (4)  A summary of the activities of the council during the preceding year.

      SECTION 2.  This Act shall take effect upon its approval.
