STATE OF HAWAII

A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII SPORTS COMMISSION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

Hawaii Sports Commission

     §    -1  Definitions.  As used in this chapter:

     "Agency" means any agency, department, authority, board, commission, the University of Hawaii, or any other political subdivision of the State.

     "Board" means the Hawaii sports commission board.

     "Commission" means the Hawaii sports commission.

     "Executive director" means the executive director of the Hawaii sports commission.

     §    -2  Hawaii sports commission; establishment; executive director.  There is established the Hawaii sports commission, which shall be responsible for implementing the purposes of this chapter.  The commission shall be placed within the department of business, economic development, and tourism for administrative purposes only.  The commission shall be administered by an executive director, who shall not be subject to chapters 76 and 89.  The executive director shall be appointed by the board, and serve at the pleasure of the board.

     §    -3  Powers and duties of the commission.  The commission shall be responsible for:

     (1)  Developing sporting events that will generate economic activity for the State;

     (2)  Enhancing existing sporting events and sports related programs in the State;

     (3)  Developing, coordinating, and implementing long-range state policies as it relates to sports and sporting events;

(4)  Developing and implementing a strategic sports plan, which shall be updated every three years or earlier as needed to help position the State as a desirable sports destination;

     (5)  Providing technical or other assistance to agencies and private industry upon request;

     (6)  Establishing a public information and educational program to inform the public of sports and sporting events;

     (7)  Engaging the services of qualified persons to implement the commission's sports strategic plan or portions thereof as determined by the commission;

     (8)  Through its executive director, providing for the appointment of employees, subject to the approval of the commission, prescribing their duties and qualifications, and fixing their salaries, without regard to chapters 76 and 89;

     (9)  Engaging the services of consultants on a contractual basis to render professional and technical assistance and advice;

    (10)  Developing, coordinating, and implementing state policies and directions for sports related activities taking into account the economic, social, and physical impacts of sports and sporting events on the State; provided that the commission shall compile a directory of Hawaii's sports facilities and support the efforts of other state and county departments or agencies to manage, improve, and protect Hawaii's sports facilities, natural environment, and areas frequented by sport participants;

    (11)  Coordinating all agencies and advising the private sector in the development of sports activities and resources;

    (12)  Conducting market development-related research as necessary;

    (13)  Promoting sports-related activities and events;

    (14)  Coordinating the development and enhancement of new and existing sports industry programs with other agencies in the State, the counties, and the private sector;

    (15)  Perpetuating existing youth sports industry programs, developing new youth sports industry programs, and coordinating with the counties and the private sector to achieve these goals;

    (16)  Performing other necessary or desirable functions to facilitate the intent of this chapter; and

    (17)  Performing other functions required or authorized by law.

     §    -4  Hawaii sports commission board; appointment, number, and term of members; duties.  (a)  The commission shall be headed by a policy-making board of directors that shall consist of thirteen members:

     (1)  Eight members shall be appointed by the governor as provided in section 26-34;

     (2)  The executive director of the Hawaii tourism authority, or its designee; and

     (3)  The mayors of each county or their respective designees.

     (b)  Appointed board members shall serve not more than three consecutive four-year terms, with each term beginning on July 1; provided that the terms of the initial appointed members shall be staggered as follows:

     (1)  Four members to serve four-year terms; and

     (2)  Four members to serve two-year terms.

     (c)  The board shall elect a chairperson from among the members.

     (d)  In appointing members, the governor shall select persons who have had experience in sport event management, sports promotion, and events marketing, or have held leadership positions in the business community, visitor industry, or sporting events industry in Hawaii.  The members of the board shall serve without compensation.

     (e)  The board shall meet as often as necessary.

     §    -5  Sports promotion activities.  The commission may enter into contracts and agreements that include the following purposes:

     (1)  Sports marketing and development;

     (2)  Market development-related research;

(3)  Product development and diversification issues focused on sports-related visitors;

     (4)  Promotion and development of sports-related activities and events;

     (5)  Promotion of Hawaii, through a coordinated statewide effort, as a sports destination;

     (6)  Reduction of barriers to implementing sporting events in the State; and

     (7)  Any and all other activities necessary to carry out the intent of this chapter;

provided that for any contract or agreement valued at $25,000 and over, the commission shall provide notice in writing to the director of the department of business, economic development, and tourism.

     §    -6  Hawaii sports commission special fund.  (a)  There is created within the state treasury a Hawaii sports commission special fund, into which shall be deposited:

     (1)  Appropriations by the legislature;

     (2)  Private contributions, gifts, grants, and other funds accepted by the commission; and

     (3)  Proceeds, royalties, licensing fees, and other sources of revenue negotiated by the Hawaii sports commission.

     (b)  Moneys in the Hawaii sports commission special fund shall be used by the commission for the payment of administrative costs and any and all expenses arising from events, promotions, and marketing of sporting events pursuant to section     -3.

     (c)  Moneys in the Hawaii sports commission special fund may be invested by the director of finance, as provided in section 36-21, until such time as the moneys may be needed.

     (d)  All interest accruing from investment of the moneys in the special fund shall be credited to the Hawaii sports commission special fund.

     §    -7  Assistance by state and county agencies.  Any state or county agency may render services upon request of the commission.

     §    -8  Annual report.  The commission shall submit a complete and detailed report of its activities, expenditures, and results to the governor and the legislature at least twenty days prior to the convening of each regular session of the legislature.

     §    -9  Rules.  The department of business, economic development, and tourism shall adopt rules in accordance with chapter 91 for the purposes of this part."

     SECTION 2.  There is appropriated out of the Hawaii sports commission special fund the sum of $100,000 or so much thereof as may be necessary for fiscal year 2010-2011 for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2010.
