STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO FOOD SUPPLY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature recognizes that the number of animal slaughterhouses in the State, and their respective capacities, are limited. Notably, only one slaughterhouse on Oahu currently slaughters hogs. If any slaughterhouse ceases operations, or ceases to slaughter any particular type of animal, the effects on the State's food supply, market, businesses, and consumers could be devastating. The legislature therefore finds that the State should avert this potential outcome and ensure a sustainable source of animal protein for the State's consumers.

Accordingly, the purpose of this Act is to:

(1) Require the department of business, economic development, and tourism, in collaboration with the agribusiness development corporation, to identify sites throughout the State that are suitable for the development of slaughterhouses;

(2) Require the agribusiness development corporation to plan, design, construct, and operate new animal slaughterhouses throughout the State; and

(3) Appropriate moneys for slaughterhouse development.

SECTION 2. Chapter 163D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§163D- Animal slaughterhouses. (a) The department of business, economic development, and tourism, in collaboration with the corporation, shall identify sites throughout the State that, based on location, land usage, and available resources, are suitable for the development of slaughterhouses.

(b) The corporation shall plan, design, construct, and operate animal slaughterhouses at each site identified pursuant to subsection (a).

(1) Consider market conditions in determining the types and sizes of animals that should be slaughtered at any given time;

(2) Ensure that each slaughterhouse:

(A) Serves as a sustainable source of locally born and raised animal protein; and

(B) Harvests or processes non-beef animals, including axis deer, hogs, sheep, and goats, for local food production; and

(3) Comply with any requirements established by:

(A) The United States Department of Agriculture;

(B) The department of health; and

SECTION 3. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $ or per cent. This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only. The reasons for exceeding the general fund expenditure ceiling are that:

(1) The appropriation made in this Act is necessary to serve the public interest; and

(2) The appropriation made in this Act meets the needs addressed by this Act.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2024-2025 for the development of slaughterhouses throughout the State, as follows:

Design $

Construction $

Equipment $

Total funding $200,000.

The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect on January 1, 2060; provided that sections 3 and 4 of this Act shall take effect on July 1, 2024.
