A BILL FOR AN ACT

 

 

Relating to Alternative Housing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Alternative housing.  (a)  Each county shall include specific regulations in the county's building code that take into account the characteristics of alternative housing that are distinct from other housing structures.

     (b)  Each county shall adopt ordinances allowing alternative housing parks to be established.

     (c)  For the purposes of this section:

     "Alternative housing" means mobile homes, shipping container housing units, micro housing units, and indigenous Hawaiian residential structures.

     "Alternative housing park" means a facility that provides services necessary to allow human habitation in alternative housing, including but not limited to water, sewage, trash collection, and distribution systems for electricity, for use by persons residing in the alternative housing park.

     "Indigenous Hawaiian residential structure" means a residential structure constructed using indigenous native Hawaiian architectural practices, styles, customs, techniques, and materials historically employed by native Hawaiians, including but not limited to residential structures composed of either rock wall or wood frame walls covered by thatches of different native grasses or other natural material for roofs.

     "Micro housing unit" means a dwelling unit with a total floor area of not less than two hundred twenty square feet, and not more than three hundred twenty square feet for not more than two occupants, and containing a separate closet, kitchen sink, cooking appliance, refrigeration facilities, and separate bathroom containing a toilet, sink, and a bathtub or shower.  The minimum and maximum total floor area shall increase an additional one hundred square feet for each occupant in excess of two.

     "Mobile home" means a structure that is eight feet or more in width and thirty-two feet or more in length, transportable in one or more sections, built on a permanent chassis, and designed to be used as a dwelling with or without a permanent foundation, when connected to the required utilities.

     "Shipping container housing unit" means an intermodal container that is converted for use as a residential structure."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2016.
