A BILL FOR AN ACT

 

 

RELATING TO WARNING SIGNS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 281-44, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  All licensed premises shall post [a]:

     (1)  A sign in or about the premises containing and notifying all customers and other persons of the possible sanctions that may be imposed for operating a vehicle under the influence of an intoxicant under sections 291E-41 and 291E-61[.]; and

     (2)  A sign separate from the sign described in paragraph (1) in or about the premises containing and notifying all customers and other persons of the risks of birth defects for women drinking alcoholic beverages during pregnancy; provided that the sign bears the following statement:  "WARNING:  Drinking alcohol during pregnancy can cause birth defects and fetal alcohol spectrum disorders, including physical, mental, behavioral, and learning disabilities".

[The sign] All signs described in paragraphs (1) and (2) shall be conspicuously positioned in order to be seen by an ordinarily observant person.  For purposes of paragraph (2), a conspicuous location shall include but not be limited to a women's restroom that is located on the licensed premises.  The statements required by paragraphs (1) and (2) shall be in type of a size determined by the liquor commission and shall appear on a contrasting background."

     SECTION 2.  The liquor commission shall determine the size of the type required pursuant to section 1 of this Act on or before August 1, 2013.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2014; provided that section 2 shall take effect upon its approval.

Description:

Requires premises licensed under chapter 281, Hawaii Revised Statutes, to have a sign posted on or about the premises, including but not limited to the women's restroom, that provides customers with a warning of the risks of birth defects and fetal alcohol spectrum disorders for women drinking alcohol during pregnancy.  Takes effect 01/01/2014.  (SD1)
