A BILL FOR AN ACT

 

 

relating to climate change.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it has established the Hawaii Climate Change Mitigation and Adaptation Commission (Climate Commission) Act 32, Session Laws of Hawaiiin 2017, established the Hawaii climate change mitigation and adaptation commission in order to address the urgent issue of sea-level rise in the State.  In less than a year, the Climate Ccommission, which comprises various state and county officials, has provided the legislature with a comprehensive sea-level rise report in which risk levels are clearly identified.  From this report, the legislature also finds it imperative to start implementing the commission's recommendations.

     The legislature further finds that the State needs to start planning and funding the coastal adaptations to sea-level rise right now, as to avoid insurmountable crises in the decade ahead.  The legislature identified believes that the most important and urgent matter to be addressed to beis the identification and determination of shoreline armoring and retreat.Given the compellation of the Commission, which includes members from BLNR, the Office of Planning, DBEDT, HTA, BOA, OHA, DOT, DOH, BOE, CZM, and from each of the counties' planning departments

     Accordingly, the purpose of this Act is to require legislature charges the Hawaii climate change mitigation and adaptation Climate Ccommission with the task to determine which coastal areas to armor and which ones to select for managed retreat.

     SECTION 2.  (a)  The Hawaii cClimate Cchange Mmitigation and aAdaptation Ccommission is hereby charged with making the determinations for each county regardingshall determine areas of each county to be designated for either armoring and which areas will be designated foror managed retreat.  The commission shall make its determinations for three predicted levels of sea-level rise:  three feet of sea-level rise SLR, six feet of sea-level riseSLR, and nine feet of sea-level riseSLR.

     SECTION 3. (b)  The Hawaii climate change mitigation and adaptation commission shall submit a report of its findings and recommendations to the legislature by December 31, 2021.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $1,000,000 or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 to complete the sea-level rise determination project[WS1] .

     The sum[WS2] s appropriated shall be expended by the Hawaii climate change mitigation and adaptation commission[WS3]  for the purposes of this Act.[WS4] 

     SECTION 4.  This Act shall take effect on July 1, 2019.[WS5]
