A BILL FOR AN ACT

 

 

RELATING TO ELECTRIC VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291-71, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Places of public accommodation with at least one hundred parking spaces available for use by the general public shall have at least one parking space per 100 spaces exclusively for electric vehicles and equipped with an electric vehicle charging system located anywhere in the parking structure or lot by July 1, 2012; provided that no parking space designated for electric vehicles shall displace or reduce accessible stalls required by the Americans with Disabilities Act Accessibility Guidelines.  Spaces shall be designated, clearly marked, and the exclusive designation enforced.  Owners of multiple parking facilities within the State may designate and electrify fewer parking spaces than required in one or more of their owned properties; provided that the scheduled requirement is met for the total number of aggregate spaces on all of their owned properties.

     This subsection shall be enforced by the appropriate county authority having jurisdiction over planning and permitting."

     SECTION 2.  Act 168, Session Laws of Hawaii 2012, section 2, is amended by amending subsection (b) to read as follows:

     "(b)  An electric vehicle on which an electric vehicle license plate is affixed shall be exempt from payment of parking fees[, including those collected through parking meters,] charged by any state or county authority in this State[,] except; provided that [this exemption shall not apply]:

     (1)  For [more than] metered parking stalls, this exemption shall be limited to two and one-half hours [of metered parking], or the maximum amount of time the meter allows, whichever is longer; or

     (2)  [To parking fees assessed in increments longer than one twenty-four-hour day, including weekly, monthly, or annual parking permits.] For non-metered parking stalls, this exemption shall be limited to the initial twenty-four hours of using the parking stall under any daily, weekly, monthly, or annual parking permit or similar agreement."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect July 1, 2050, and shall be repealed on June 30, 2020.

Description:

Requires a ratio of one electric vehicle parking stall to be reserved per 100 stalls in places of public accommodations.  Designates the appropriate county authority having jurisdiction over planning and permitting for enforcement.  Clarifies the electric vehicle parking fee exemption for metered and non-metered state or county parking stalls.  Repeals 6/30/2020.  Effective 7/1/2050.
