SENATE CONCURRENT

RESOLUTION

 

 

Approving the sale of certain land owned by the office of hawaiian affairs to the city and county of honolulu.

 

 


     WHEREAS, the State of Hawaii transferred to the Office of Hawaiian Affairs the fee simple interest in certain parcels in Kakaako, including tax map key no. (1) 2-1-015:061 (Parcel I), pursuant to Act 15, Session Laws of Hawaii 2012; and

 

     WHEREAS, section 171-64.7, Hawaii Revised Statutes, requires the prior approval of the Legislature, by concurrent resolution, to sell in fee simple certain lands classed as government or crown lands previous to August 15, 1895, or acquired or reserved by the government upon or subsequent to that date by purchase, exchange, escheat, or the exercise of the right of eminent domain, or any other manner; and

 

     WHEREAS, section 171-64.7(c), Hawaii Revised Statutes, states that "[t]he concurrent resolution shall contain the following information:

 

     (1)  The specific location and size in square feet or in other precise measure of the parcels of land to be sold or given;

 

     (2)  The appraisal value of the land to be sold or given;

 

     (3)  The names of all appraisers performing appraisals of the land to be sold or given;

 

     (4)  The date of the appraisal valuation;

 

     (5)  The purpose for which the land is being sold or given;

 

     (6)  A detailed summary of any development plans for the land to be sold or given; and

 

     (7)  A statement of whether the land is, or is not, land that was classed as government or crown lands previous to August 15, 1895, or was acquired by the State in exchange for such lands, and a detailed explanation of how the state department or agency made this determination."; and

 

     WHEREAS, the Office of Hawaiian Affairs desires to obtain legislative approval to sell the fee interest in Parcel I and provides the following information pursuant to section 171‑64.7(c), Hawaii Revised Statutes:

 

     (1)  Parcel I is located on Forrest Avenue and Ala Moana Boulevard, Honolulu, Hawaii, in the Kakaako makai area, is identified as tax map key no. (1) 2-1-015:061, and is approximately 141,832 square feet;

 

     (2)  The fee interest in Parcel I was appraised to have a fair market value of $29,640,000;

 

     (3)  Parcel I was appraised by James E. Hallstrom, Jr., and Brian S. Goto of CBRE, Inc.;

 

     (4)  The appraisal valuation date is December 5, 2017;

 

     (5)  The primary purpose for a sale to the City and County of Honolulu would be to address municipal sewage needs and increase system capacity to service the east Honolulu service basin, including other Kakaako makai lands owned by the Office of Hawaiian Affairs;

 

     (6)  The development plans for Parcel I would be to build a major pump station and/or other wastewater facility, as determined by the needs of the City and County of Honolulu; and

 

     (7)  Parcel I was classed as government or crown lands previous to August 15, 1895.  This status was determined through a title search conducted by staff of the Office of Hawaiian Affairs in connection with the acquisition of Parcel I by the Office of Hawaiian Affairs; and

 

     WHEREAS, a draft of this concurrent resolution was submitted to the Office of Hawaiian Affairs at least three months prior to the convening of the Regular Session of 2018; and

 

     WHEREAS, the Office of Hawaiian Affairs duly conducted an informational briefing on the sale of Parcel I at a publicly noticed meeting of the Office of Hawaiian Affairs on March 7, 2018, in the ahupuaa of Honolulu, moku of Kona, mokupuni of Oahu; now, therefore,

 

     BE IT RESOLVED by the Senate of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the House of Representatives concurring, that the sale of the fee simple interest in certain parcels in Kakaako, including tax map key no. (1) 2-1-015:061, from the Office of Hawaiian Affairs to the City and County of Honolulu is approved; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Trustees of the Office of Hawaiian Affairs and Mayor of the City and County of Honolulu.
