SENATE CONCURRENT

RESOLUTION

 

 

Requesting the Department of Education to conduct a Wellness visit for any child who has been removed from a Department of Education school to be homeschooled.

 

 


     WHEREAS, by law, employees or officers of any public or private school are required to report to the Department of Human Services or the police department suspected child abuse or neglect or any belief of a significant risk that child abuse or neglect may occur; and

 

     WHEREAS, a parent or guardian of a child may submit Form 4140, Exceptions to Compulsory Education, which allows the withdrawal from school of a student due to a disability, employment, a family court order, alternative educational programs, or homeschooling; and

 

     WHEREAS, each public school establishes its own protocols for conducting a wellness visit to the homeschooled student; and

 

     WHEREAS, when a child is homeschooled, a child may be seen by a Department of Education staff when the child's assessment is due for third, fourth, fifth, eighth, and tenth grades for children who take the assessment tests on school property; and

 

     WHEREAS, the Department of Education does not have an official process for the timing of visits to a homeschooled student; and

 

     WHEREAS, the Office of Student Support Services oversees the appropriate education for homeschooled students; and

 

     WHEREAS, no information has been provided to the Legislature regarding the welfare of homeschooled students and the services that the Office of Student Support Services provides; now, therefore,

 

     BE IT RESOLVED by the Senate of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2024, the House of Representatives concurring, that the Department of Education is requested to conduct a wellness visit for any child who has been removed from a Department of Education school to be homeschooled; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Superintendent of Education, Chairperson of the Board of Education, and Director of Human Services.
