STATE OF HAWAII

 

 

 

 

 

SENATE RESOLUTION

 

 

Requesting the department of business, economic development, and tourism, city and county of honolulu, and counties of hawaii, maui, and kauai to convene a working group to review and offer amendments to chapter 53, hawaii revised statutes.

 

 


     WHEREAS, the Urban Renewal Law is codified as chapter 53, Hawaii Revised Statutes; and

 

     WHEREAS, the Urban Renewal Law was originally enacted in 1949 for the purpose of securing federal financial assistance for urban redevelopment projects through the creation of special public bodies with extraordinary powers to undertake such projects; and

 

     WHEREAS, numerous projects throughout the State have utilized the Urban Renewal Law, including the Maui Redevelopment Agency, Wailuku Redevelopment Plan, and Wailuku Redevelopment Area in the County of Maui; and

 

     WHEREAS, the County of Hawaii is considering creating the Banyan Drive Redevelopment Agency pursuant to section 53-2, Hawaii Revised Statutes; and

 

     WHEREAS, the Urban Renewal Law has been amended several times since it was enacted; and

 

     WHEREAS, further amendments to the Urban Renewal Law may be necessary for chapter 53, Hawaii Revised Statutes, to remain consistent with other existing laws and the current state of Hawaii's counties; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, that a working group be established consisting of the Director of Business, Economic Development, and Tourism; Director of Planning for the Counties of Hawaii, Maui, and Kauai; and Director of Planning and Permitting for the City and County of Honolulu; and

 

     BE IT FURTHER RESOLVED that the working group is requested to review the application of chapter 53, Hawaii Revised Statutes, and offer amendments to the chapter; and

 

     BE IT FURTHER RESOLVED that the working group is requested to submit a report, including updated definitions and terms as relating to existing laws and programs, and an updated organizational framework of the counties since the introduction of chapter 53, Hawaii Revised Statutes, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2017; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Business, Economic Development, and Tourism; Director of Planning for the County of Hawaii; Director of Planning for the County of Maui; Director of Planning for the County of Kauai; and Director of Planning and Permitting for the City and County of Honolulu.
